Additional information: Riigihanget ei ole jagatud osadeks, kuna hankelepingu esemeks on karbifarmi süsteemi tarnimine ja paigaldamine. Tegemist on integreeritud meretehnilise süsteemiga, mille töökindlus, ohutus ja nõuetele vastavus sõltuvad komponentide ühilduvusest ning paigalduse korrektsest teostamisest. Hanke jagamine eraldi tarneks ja paigalduseks suurendaks tehnilisi, garantiilisi ja õiguslikke riske, sh vastutuse ja rikke põhjuse tuvastamise keerukust, ning ajakriitiliste meretööde koordineerimisriski. Kui hanke alusdokumentides on märgitud kindel ostuallikas, protsess, kaubamärk, patent, tüüp, päritolu, tootmisviis või RHS § 88 lg-s 2 nimetatud alus, on RHS § 88 lg 3, 6 ja 7 kohaselt pakkujatel alati õigus pakkuda samaväärseid tooteid, olenemata sellest, kas hankija on lisanud märke „või sellega samaväärne“.

Tegemist on integreeritud meretehnilise süsteemiga, mille töökindlus, ohutus ja nõuetele vastavus sõltuvad komponentide ühilduvusest ning paigalduse korrektsest teostamisest. Hanke jagamine eraldi tarneks ja paigalduseks suurendaks tehnilisi, garantiilisi ja õiguslikke riske, sh vastutuse ja rikke põhjuse tuvastamise keerukust, ning ajakriitiliste meretööde koordineerimisriski.
