Jednocześnie ustalenie pochodzenia dostawy nastąpi przy uwzględnieniu przepisu art. 60 rozporządzenia Parlamentu Europejskiego i Rady (UE) nr 952/2013 z dnia 9 października 2013 r. ustanawiającego unijny kodeks celny, zgodnie z którym towar całkowicie uzyskany w danym kraju lub na danym terytorium uznawany jest za pochodzący z tego kraju lub terytorium (ust. 1). Towar, w produkcję którego zaangażowane są więcej niż jeden kraj lub więcej niż jedno terytorium, uznaje się za pochodzący z kraju lub terytorium, w którym towar ten został poddany ostatniemu istotnemu, ekonomicznie uzasadnionemu przetwarzaniu lub obróbce, w przedsiębiorstwie przystosowanym do tego celu, co spowodowało wytworzenie nowego produktu lub stanowiło istotny etap wytwarzania (ust. 2). Na podstawie art. 226 ust. 1 pkt 5 w zw. z art. 16b ust. 2 PZP, zamawiający odrzuci ofertę, której przedmiotem będzie dostawa w całości albo części pochodząca z innych państw niż państwa członkowskie Unii Europejskiej oraz innych niż państwa będące stronami Porozumienia Światowej Organizacji Handlu w sprawie zamówień rządowych lub stronami innych umów międzynarodowych gwarantujących na zasadzie wzajemności i równości dostęp do rynku zamówień publicznych, których stroną jest Unia Europejska.
