Justification for the duration of the framework agreement: De raamovereenkomst heeft conform artikel 43 WOO een looptijd van 7 jaar met een mogelijke verlenging van 1 jaar (dus maximaal 8 jaar). De aanbestedende overheid behoudt zicht het recht voor om de raamovereenkomst op te zeggen mits een opzegtermijn van 3 kalendermaanden. De langere looptijd van de raamovereenkomst is toegestaan in uitzonderlijke, deugdelijk gemotiveerde gevallen die verband houden met het voorwerp van de opdracht: een duurtijd van maximaal 8 jaar is hier in deze opdracht te verantwoorden gezien de zware investeringen die de begunstigde dienstverlener initieel zal maken vooral wat betreft de te ontwikkelen nieuwe applicaties en software alsook de integreerbare off the shelf of configureerbare software. Verder loopt de onderhoudsperiode van alle software binnen Lantis langer dan 4 jaar waarbij de relevante werknemers binnen Lantis (Digital & Data) tevens de nodige (continue) uitgebreide opleiding in dienen te verkrijgen. Tot slot, zijn de gevraagde diensten rond de hierboven vermelde, allerhande software complex in die zin dat verschillende vereisten zullen samenkomen en de dienstverlening op meerdere expertises zal moeten geleverd worden. Dit alles verantwoordt de looptijd van max. 8 jaar (7 + 1).
