Information about review deadlines: Es gilt die am 01.12.2021 in Kraft getretene Neufassung des GWB (Gesetz gegen Wettbewerbsbeschränkungen). Auf folgende Punkte wird hingewiesen: - § 134 Abs. 2 GWB: Informations- und Wartefrist Demnach darf ein Vertrag erst 15 Kalendertage nach Absendung der Information an die nicht berücksichtigten Bieter geschlossen werden. Wird die Information auf elektronischem Weg oder per Fax versendet, verkürzt sich die Frist auf 10 Kalendertage. Die Frist beginnt am Tag nach der Absendung der Information durch den Auftraggeber; auf den Tag des Zugangs beim betroffenen Bieter und Bewerber kommt es nicht an. - § 135 Abs. 2 GWB: Unwirksamkeit Die Unwirksamkeit [des öffentlichen Auftrags] kann nur festgestellt werden, wenn sie im Nachprüfungsverfahren innerhalb von 30 Kalendertagen nach der Information der betroffenen Bieter und Bewerber durch den öffentlichen Auftraggeber über den Abschluss des Vertrages, jedoch nicht später als 6 Monate nach Vertragsschluss geltend gemacht worden ist.
