Other justification: Hankinnan toteutus puolustus- ja turvallisuushankintalain 22 §:n 1 momentin 3 kohdan nojalla suoraan valitulta toimittajalta on perusteltua, sillä yksinoikeuden suojaamiseen liittyvästä syystä vain tietty toimittaja voi toteuttaa hankinnan. Hankinnan kohteena olevien varaosien täysi yhteensopivuus käytössä olevien Hawk Mk51, Mk51A ja Mk66 -suihkuharjoitus-koneiden Adour Mk851 ja Mk861 -moottoreiden kanssa voidaan varmistaa ainoastaan moottorivalmistajan hyväksymien alkuperäisten varaosien avulla. Kyseessä olevien moottoreiden tekninen tuotevastuu on moottorivalmistajalla, eikä valmistaja vastaa moottoreiden toimivuudesta, turvallisuudesta tai kokonaisuudesta, mikäli moottoreissa käytetään muita kuin valmistajan hyväksymiä varaosia. Moottorivalmistaja Rolls Royce plc. omistaa moottoreihin ja niihin liittyviin varaosiin kohdistuvat immateriaalioikeudet eikä ole lisensoinut varaosien valmistusta tai myyntiä kolmansille osapuolille. Näin ollen hankinnan toteuttaminen muulta toimittajalta ei ole teknisistä ja oikeudellisista syistä mahdollista. Edellä mainituin perustein hankinta toteutetaan suorahankintana moottorivalmistajalta, Rolls Royce plc.
