Für den Fall, dass der Ausschreibungsgewinner vor vollständiger Leistungserbringung wegen Kündigung, Insolvenz oder aus einem anderen Grunde endgültig ausfällt, behält sich die Auftraggeberin vor, die verbleibenden Arbeiten den übrigen Bietern/ Bieterinnen in der Reihenfolge des Ausschreibungsergebnisses bis Platz 5 anzutragen. Die dadurch entstehenden Mehrkosten sind unter dem Gesichtspunkt der Ersatzvornahme vom bisherigen Auftragnehmer/ von der bisherigen Auftragnehmerin zu tragen. 2. Enthalten die Vergabeunterlagen nach Auffassung des Unternehmens Unklarheiten, Unvollständigkeiten oder Fehler, so hat es unverzüglich die Vergabestelle vor Angebotsabgabe in Textform darauf hinzuweisen. 3. Im Falle der Nutzung der e-Vergabe, ist der Nutzer verpflichtet, sich regelmäßig in der e-Vergabe anzumelden, um neue Informationen zu Vergabeverfahren zu erhalten. Bei der Teilnahme an laufenden Vergabeverfahren soll das Anmelden täglich durchgeführt werden. Ein Anspruch auf den Erhalt von automatisierten E-Mails der e- Vergabe besteht nicht.
