La finalité de l’action d’insertion est avant tout de permettre à des personnes, rencontrant des difficultés particulières d’insertion, d’acquérir ou de réacquérir une compétence professionnelle et d’accéder à l’emploi durable. Le pouvoir adjudicateur se réserve la possibilité de confier ultérieurement, au titulaire, un ou plusieurs marchés sur le fondement de l’article R2122-7 du code de la commande publique, ayant pour objet la réalisation de prestations similaires. La durée pendant laquelle les nouveaux marchés peuvent être conclus ne peut dépasser trois ans à compter de la notification du marché initial. Négociation pour les lots 4 « Couverture et façades ardoise » ; Lot 5 « Etanchéité » ; Lot 6 « Bardage métallique » ; Lot 7 « Menuiseries extérieures / occultations » ; Lot 8 « Charpente métallique / serrurerie » ; Lot 10 « Menuiseries intérieures / signalétiques » ; Lot 16 « Couverture bac acier – Photovoltaïque » et le lot 23 « Nettoyage » Conformément à l’article R2123-5 du code de la commande publique, après une première analyse des offres sur la base des critères de jugement définis ci-dessus, le pouvoir adjudicateur établit un classement et se réserve la possibilité d’ouvrir une phase de négociation avec le ou les soumissionnaires dont les offres seront les mieux classées. Toutefois, le pouvoir adjudicateur pourra attribuer le marché sur la base des offres initiales sans négociation. La négociation sera menée dans le respect du principe d’égalité de traitement des soumissionnaires. Les modalités de cette négociation seront précisées dans les courriers d’invitation à négocier. Cette négociation aura pour objectif d’optimiser la ou les offres sélectionnées tant d’un point de vue qualitatif et technique que financier. La collectivité se réserve le droit de ne pas donner suite à la consultation. Pour les lots 18 « Bâtiments modulaires » et 19 « Ateliers temporaires chapiteau » une clause de réexamen est prévue : Dans l’hypothèse où une prolongation de la location des bâtiments modulaires ainsi que du chapiteau des ateliers provisoires s’avérait nécessaire en raison d’une prolongation du délai d’exécution des travaux de la présente opération, un acte unilatéral sera établi par la Région. Concernant le prix de la location, il sera établi au regard du prix unitaire de la location des bâtiments modulaires ainsi que du chapiteau indiqué dans la décomposition du prix global et forfaitaire de chacun de ces lots et multiplié par le nombre de mois de prolongation de ces locations au prorata temporis. Dans la limite d’une durée totale de prolongation de 12 mois
