Other justification: Lepingu sõlmimise aluseks väljakuulutamiseta läbirääkimistega hankemenetlusena on RHS § 173 lg 1 p 3: lepingu saab sõlmida ainult ühe pakkujaga tehnilistel või ainuõiguste kaitsega seotud põhjustel. Eesti Kaitseväes kasutusel olevad Leopard 1 toetustankid on pikalt kasutusel olnud soomusmasinad. Kuna hetkel on turul olemas mitmeid sarnaseid ja edasi arendatud soomusmasinaid, siis ei ole tootjal ega ka teistel turul olevatel soomusmasinate ümberehitamise ja hooldamisega tegelevatel ettevõtetel huvi suuremate ümberehitamiste võimekusi omada ega arendada (riigid on soomusmasinad juba välja vahetanud või planeerivad seda teha). Kuna varuosade ja elutsükli hoolduse ostmisel esinevad samasugused probleemid, siis suudab kõiki vajalikke ümberehituse teha, elutsükli teenuseid osutada, varuosasid ja komponente müüa vaid FFG. Teisi samasuguse võimekusega ettevõtteid turul ei eksisteeri.
