(a) Posibilitatea retragerii sau modificarii ofertei: nicio oferta nu poate fi retrasa dupa data-limita de depunere precizata si anuntul de participare, sub sanctiunea excluderii acestuia la procedura pentru atribuirea contractului de achizitie publica si a pierderii garantiei de participare. Comisia de evaluare, cu acceptul operatorului economic, corecteaza erorile aritmetice si remediaza viciile de forma ale documentelor si ofertelor prezentate de catre acesta [art. 134 alin. (10) din HG 395/2016). Daca operatorul economic modifica oferta dupa deschidere sau nu accepta remedierea viciilor sau corectia erorilor, aceasta va fi considerata neconforma [art. 134 alin. (11) din HG 395/2016];
(b) Asociere. În cazul asocierii mai multor operatori economici cu scopul de a depune oferta comuna, îndeplinirea cerintelor privind situatia personala a ofertantului, capacitatea de exercitare a activitatii profesionale si standardele de asigurare a calitatii trebuie sa fie îndeplinite de fiecare asociat în parte, iar cerinta privind capacitatea tehnica si/sau profesionala trebuie sa fie îndeplinita prin cumul de grupul de asociati. Se va prezenta acordul de asociere din care vor rezulta cel putin urmatoarele: faptul ca asociatii sunt responsabili solidar si nelimitat de executarea contractului, nominalizarea liderului asociatiei, comunicarile si platile se vor face de liderul asociatiei;
(c) Documentele emise într-o limba straina vor fi însotite de traduceri autorizate în limba româna.
