Description5.2.3 Exceptions from weighting the environment The contracting authority has assessed the use of climate and environmental considerations in light of the utilities regulations §7-9 in this procurement. The main rule in accordance with §7-9 second paragraph is that climate and environmental considerations shall be weighted with a minimum of 30 percent in the award criteria. Pursuant to §7-9 fourth paragraph, however, the award criteria can be replaced with climate and environmental requirements in the requirement specification, if it is clear that this gives a better climate and environmental effect, and this is justified in the procurement documents. The contracting authority has made a concrete assessment of the nature and execution of the relevant procurement, and it is assumed that the climate and environmental impact is mainly related to how the construction work and the accompanying transport are actually carried out, including the use of machines and vehicles. Furthermore, it is considered that binding minimum requirements in the requirement specifications provide a more predictable and safe reduction of emissions than the use of award criteria alone, as the requirements apply during the entire contract, independent of the tender evaluation. Oslo municipality ́s standard climate and environmental requirements for building and construction procurements have form the basis for the contract. In accordance with these requirements, there are minimum requirements regarding emission free execution of the construction work, including that all work at the building and construction site shall be carried out emission free. The following applies to the last transport stretch/cargo mile for mass transport and other transport: • Tenderers are obliged to use vehicles that are either emission free or biogas based in the execution of the contract. All relevant environmental performance is therefore regulated as an absolute minimum requirement, which safeguards climate and environmental considerations in the best possible way.
