Information about review deadlines: Article 6 – Procedure If an appeal is accepted for consideration, the Committee shall invite the respondent and any interested parties to submit comments within a period that shall generally not exceed 10 days. The appellant shall then normally be given up to 10 days to comment on those submissions. After receiving the appellant’s final observations, the Committee shall decide the case unless it orders an oral hearing or further investigation. Article 7 – Procedure for Interim Suspension of Contract Award The respondent and any interested parties shall normally be given up to three calendar days to comment on a request for interim suspension of the procurement procedure or contract award. In cases of a clear and manifest breach of public procurement rules, the Committee may order an interim suspension without prior comments from the respondent. The Committee shall decide the request as soon as possible but may defer its consideration until the final decision if the conditions for suspension are clearly not met. Article 8 – Procedure for Lifting a Suspension of Contract Award The Committee may lift the automatic prohibition on contract award arising from an appeal lodged during the statutory standstill period, either on the respondent’s request or on its own initiative. It may decide such a request without obtaining further comments from the appellant. If acting on its own initiative, the Committee will normally give the parties an opportunity to comment before making its decision.
