Review description: Wniesione odwołanie dotyczyło czynności polegających na: a) ponownym wyborze jako najkorzystniejszej oferty złożonej przez wykonawcę Auto Podlasie Sp. z o.o. z siedzibą w Siedlcach, pomimo że oferta ta wg odwołującego nie odpowiada treści Specyfikacji Warunków Zamówienia (SWZ) w zakresie wymagań dotyczących przedniego układu zabezpieczającego (orurowania przedniego), określonych w OPZ; b) zaniechaniu odrzucenia oferty wykonawcy Auto Podlasie Sp. z o.o. na podstawie art. 226 ust. 1 pkt 5 ustawy Pzp, mimo iż wg. odwołującego treść oferty nie odpowiada warunkom zamówienia określonym w SWZ. W związku z powyższym wniesiono o: a) unieważnienie czynności ponownego wyboru oferty Auto Podlasie Sp. z o.o. jako oferty najkorzystniejszej; b) nakazanie Zamawiającemu odrzucenia oferty złożonej przez Auto Podlasie Sp. z o.o. na podstawie art. 226 ust. 1 pkt 5 ustawy Pzp; c) nakazanie Zamawiającemu dokonania ponownego badania i oceny ofert oraz dokonania wyboru oferty najkorzystniejszej spośród ofert niepodlegających odrzuceniu. KRAJOWA IZBA ODWOŁAWCZA wyrokiem z dnia 22/05/2026 oddaliła odwołanie wniesione przez wykonawcę GLOMEX MS POLSKA sp. z o.o.
