Menținerea în funcțiune a sistemului de prelucrare automatizată a operațiunilor efectuate pe piețele financiare internă și internațională (operațiunile de administrare a rezervelor internaționale, operațiunile de politică monetară și operațiunile efectuate pe contul Ministerului Finanțelor și altor ministere) - Straight Through Processing (Treasury Management System) – (STP), cu toate funcționalitățile sale existente așa cum sunt acestea instalate pe serverele BNR (verisunea 7.4.43), respectiv eliminarea riscurilor operaționale și menținerea eficienței (vitezei de prelucrare) în desfășurarea activităților aferente Direcției operațiuni de piață, Direcției plăți și Direcției contabilitate.

Explanation:
BNR nu poate achiziționa dreptul de utilizare (licență) și serviciile de mentenanță pentru sistemul integrat STP de la un alt furnizor decât de la WSS, fapt care nu permite derularea de către autoritatea contractantă a unei proceduri care să implice mai mulți furnizori. De asemenea, considerăm că nu există o soluție alternativă sau înlocuitoare rezonabilă, cum ar fi utilizarea unor canale de distribuție alternative pe teritoriul României ori în afara acestuia sau achiziția unor produse sau servicii comparabile din punct de vedere funcțional, iar absența concurenței sau protecția drepturilor exclusive nu sunt rezultatul unei restrângeri artificiale de către autoritatea contractantă a parametrilor achiziției în vederea viitoarei proceduri de atribuire.Prin urmare, conform prevederilor art.104, alin.(1), lit. b), respectiv art.104, alin. (2), lit. b) şi c) din Legea nr.98/2016 privind achiziţiile publice, atribuirea contractului de achiziţie publică se va realiza prin procedura de negociere fără publicare prealabilă a unui anunţ de participare.
