Justification for the accelerated procedure: Działając na podstawie art. 138 ust. 2 pkt 2 ustawy z dnia 11 września 2019 r. – Prawo zamówień publicznych (Dz.U. z 2024 r. poz. 1320 ze zm.), Zamawiający wskazuje, iż w przedmiotowym postępowaniu zachodzi pilna potrzeba udzielenia zamówienia, uzasadniająca skrócenie terminu składania ofert. Przedmiotem zamówienia jest zakup produktów leczniczych i farmaceutycznych dla Wojewódzkiego Specjalistycznego Szpitala im. M. Pirogowa w Łodzi. Wskazać należy, iż niniejsze postępowanie stanowi powtórzenie procedury przetargowej. Wcześniej prowadzone przez Zamawiającego postępowanie w tym samym przedmiocie zamówienia (ZP/14/2026) zostało w częściach obejmujących obecny przedmiot zamówienia unieważnione na podstawie art. 255 pkt 1 ustawy PZP, z uwagi na brak ofert. Powyższa okoliczność ma charakter w pełni obiektywny i niezależny od Zamawiającego, który dochował należytej staranności, wszczynając pierwotną procedurę z odpowiednim wyprzedzeniem czasowym. Zapewnienie nieprzerwanego dostępu do produktów leczniczych stanowi podstawowy obowiązek Zamawiającego jako podmiotu wykonującego działalność leczniczą, wynikający w szczególności z przepisów ustawy z dnia 15 kwietnia 2011 r. o działalności leczniczej oraz realizujący konstytucyjne prawo obywateli do ochrony zdrowia, o którym mowa w art. 68 ust. 1 Konstytucji Rzeczypospolitej Polskiej. W zaistniałej sytuacji unieważnienia poprzedniej procedury, ponowne przeprowadzenie postępowania w pełnym, standardowym terminie unijnym doprowadziłoby do powstania tzw. "luki zakupowej" i braku pokrycia umownego na kluczowe leki. Niezawarcie umowy w odpowiednim czasie mogłoby skutkować ograniczeniem lub wstrzymaniem udzielania świadczeń zdrowotnych, co stanowiłoby bezpośrednie zagrożenie dla życia i zdrowia pacjentów oraz naruszenie obowiązku zapewnienia ciągłości i dostępności świadczeń zdrowotnych. Wskazana pilna potrzeba udzielenia zamówienia ma charakter obiektywny. Zużycie produktów leczniczych pozostaje uzależnione od bieżących potrzeb zdrowotnych pacjentów, których dynamika nie jest możliwa do pełnego przewidzenia na etapie planowania postępowań o udzielenie zamówienia publicznego, a konieczność unieważnienia poprzednich części zmusiła Zamawiającego do natychmiastowej i nadzwyczajnej reakcji w celu ochrony bezpieczeństwa pacjentów. Skrócenie terminu składania ofert do 15 dni pozostaje proporcjonalne do zaistniałych okoliczności oraz nie narusza zasad prowadzenia postępowania o udzielenie zamówienia publicznego, w szczególności zasad uczciwej konkurencji, równego traktowania wykonawców oraz przejrzystości, o których mowa w art. 16 ustawy Prawo zamówień publicznych. Przedmiot zamówienia był już znany rynkowi z racji poprzedniego postępowania, co dodatkowo ułatwi wykonawcom sprawne przygotowanie ofert.
