Justification for the accelerated procedure: Naročnik uporablja pospešeni odprti postopek zaradi potrebe po pravočasni zagotovitvi neprekinjene dobave živil za izvajanje šolske prehrane od 1. 9. 2026 dalje. Predmet javnega naročila je sukcesivna dobava ekoloških in konvencionalnih živil, ki je nujna za redno izvajanje dejavnosti naročnika. Naročnik mora pred začetkom izvajanja dobav pravočasno izvesti pregled in ocenjevanje ponudb po posameznih sklopih, sprejeti odločitev o oddaji javnega naročila, zagotoviti potek rokov pravnega varstva ter skleniti okvirne sporazume z izbranimi dobavitelji. Zaradi navedenega naročnik ne more uporabiti rednega 30-dnevnega roka za prejem ponudb. Skrajšani rok za prejem ponudb je kljub temu sorazmeren, saj se ponudbe oddajo elektronsko, dokumentacija je gospodarskim subjektom dostopna elektronsko od dneva objave, predmet naročila je natančno določen v razpisni dokumentaciji in ponudbenem predračunu OBR-2, ponudniki pa lahko oddajo ponudbo za en sklop, več sklopov ali vse sklope. Rok za prejem ponudb ni krajši od zakonsko dopustnega minimalnega roka za pospešeni odprti postopek.

Description: Naročnik je proučil prejeta vprašanja in bo zaradi večje jasnosti, primerljivosti ponudb in odprave posameznih nejasnosti objavil popravek ponudbenega predračuna OBR-2. Ponudniki morajo pri pripravi ponudbe uporabiti popravljeni ponudbeni predračun OBR-2, ki bo objavljen na Portalu javnih naročil oziroma v sistemu e-JN. Popravek ponudbenega predračuna je sestavni del dokumentacije v zvezi z oddajo javnega naročila in je za ponudnike zavezujoč. Ponudniki so dolžni pri pripravi ponudbe upoštevati celotno dokumentacijo, vsa objavljena pojasnila in vse objavljene popravke. 1. Stolpec »Naziv blaga in blagovna znamka izdelka« Naročnik je v popravljenem ponudbenem predračunu OBR-2 zaradi večje jasnosti dopolnil naziv stolpca, in sicer se stolpec sedaj glasi: »Naziv blaga in blagovna znamka izdelka«. Ponudniki morajo v navedeni stolpec vpisati točen prodajni oziroma komercialni naziv ponujenega artikla ter blagovno znamko izdelka oziroma proizvajalca, kadar je to potrebno za enolično identifikacijo ponujenega blaga. Vpis zgolj generičnega naziva, npr. sol, sladkor, moka, čaj ipd., ne zadostuje, če iz takega vpisa ni mogoče jasno ugotoviti, kateri konkretni artikel ponudnik ponuja. 2. Popravek ponudbenega predračuna pri sirupih in konzerviranih živilih Naročnik je v popravljenem ponudbenem predračunu OBR-2 popravil tudi posamezne enote mere oziroma opise artiklov, zlasti pri sirupih in pri sklopu konzerviranega sadja in zelenjave. Pri sirupih se cena poda na enoto mere, kot je določena v popravljenem OBR-2, pri čemer mora ponudnik v stolpec »Ponujeno pakiranje« vpisati dejansko ponujeno pakiranje. Pri artiklih iz sklopa Konzervirano sadje in zelenjava, pri katerih je bilo prvotno navedeno pakiranje »3/1« oziroma druga nejasna oznaka, je naročnik zaradi večje primerljivosti določil enoto mere in dopustni razpon pakiranja, kot izhaja iz popravljenega OBR-2. Ponudniki morajo ceno podati na enoto mere, določeno v popravljenem ponudbenem predračunu, in v stolpec »Ponujeno pakiranje« vpisati dejansko ponujeno pakiranje. Pri artiklu rdeča pesa naročnik dopušča pakiranje v kozarcu ali konzervi, kot je določeno v popravljenem OBR-2. Artikel mora izpolnjevati zahtevo glede najmanjšega deleža pese. Ponudba artikla, ki vsebuje manjši delež pese od zahtevanega, ni dopustna. 3. Umik posameznih artiklov iz ponudbenega predračuna Naročnik je iz ponudbenega predračuna OBR-2 umaknil posamezne artikle, pri katerih je ocenil, da bi lahko zaradi razpona gramatur, enote mere kom/kos oziroma drugih okoliščin prihajalo do neprimerljivosti ponudb. Iz ponudbenega predračuna se umaknejo oziroma se v popravljenem OBR-2 ne ponujajo naslednji artikli: • čaji v filter pakiranju z razponom 20–100 g, ki so bili določeni z enoto mere kom/kos; • podvojeni artikel čaja jagoda/vanilija; • čokolada jedilna Sweet Chef; • čokolada v prahu 100–1000 g; • jedilna čokolada temna 200–1000 g; • kava kakovost Barcaffe, do 100 g; • kvas svež 20–50 g; • pecilni prašek porcijski 13–50 g; • vanilijev sladkor porcijski 10–50 g; • rižev desert 100–200 g, 4 pakirani skupaj; • sol morska, mleta, porcijska, v dozirnici oziroma z mlinčkom. Naročnik pojasnjuje, da umaknjeni artikli niso več predmet javnega naročila, ponudbe, ocenjevanja, razvrstitve ponudb niti poznejšega naročanja po okvirnem sporazumu. Ponudniki za umaknjene artikle ne oddajajo ponudbe. Če bo ponudnik kljub objavljenemu popravku v ponudbi navedel ceno, naziv ali drug podatek za artikel, ki je bil s popravkom ponudbenega predračuna umaknjen iz predmeta naročila, bo naročnik takšno navedbo štel kot odvečen oziroma brezpredmeten podatek, ki se nanaša na artikel, ki ni več predmet javnega naročila. Naročnik cen oziroma drugih podatkov za umaknjene artikle ne bo upošteval pri pregledu, ocenjevanju, razvrstitvi ponudb, izračunu ponudbene vrednosti in sklenitvi oziroma izvajanju okvirnega sporazuma. Naročnik bo vse ponudnike v tem delu obravnaval enako: morebitni podatki za umaknjene artikle se pri nobenem ponudniku ne bodo upoštevali. Za ponudbeno vrednost, ocenjevanje, razvrstitev ponudb in pogodbene cene se upoštevajo izključno artikli, ki so predmet javnega naročila po popravljenem ponudbenem predračunu OBR-2. Ponudniki morajo pri pripravi ponudbe uporabiti popravljeni ponudbeni predračun OBR-2. Če bo ponudnik uporabil star oziroma neustrezen ponudbeni predračun ali bo ponudbo pripravil tako, da naročnik ne bo mogel zanesljivo ugotoviti ponudbene vrednosti za artikle, ki so predmet javnega naročila, oziroma ponudbe ne bo mogel zanesljivo pregledati, primerjati ali oceniti, bo naročnik ravnal skladno z dokumentacijo v zvezi z oddajo javnega naročila in ZJN-3.
