Short description
Delgaz Grid, în calitate de titular al Licențelor de distribuţie gaze naturale şi energie electrică, beneficiaza de un drept exclusiv de a presta serviciul de distribuție a gazelor naturale şi energie electrică prin sistemele de distribuție concesionate de aceasta, în localitățile precizate în anexele licentelor, prin prisma prestarii unor activitati cu caracter de monopol natural in sensul Legii 123/2012. In contextual si gaze naturale, fiind titular al licenţei pentru activitatea de distribuţie gaze naturale şi distribuţie energie electrică, are calitatea de entitate contractantă, în sensul art. 4 alin. (1) lit. c) din Legea nr. 99/2016 privind achiziţiile sectoriale si are obligatia de aaplica Legea nr.99/2016.
Obiectivele Acordului cadru / contractelor subsecvente este execuția lucrărilor de înlocuiri de conducte și racorduri de gaze naturale şi realizări de noi distribuţii de gaze naturale pentru Delgaz Grid S.A., în toate localitățile (sate, comune, orașe) aferente județelor Arad, Alba, Bacău, Bihor, Bistrița Năsăud, Botoșani, Caraș Severin, Cluj, Harghita, Hunedoara, Iași, Maramureș, Mureș, Neamț, Satu Mare, Sălaj, Sibiu, Suceava, Timiș și Vaslui, în funcție de solicitările de acces la sistem depuse la Degaz Grid S.A..Materialele puse la dispozitie de entitatea contractanta nu vor fi ofertate de operatorii economici participanti la procedura. Un op.ec. poate aplica pentru unul sau mai multe loturi . Orice op.ec interesat are dreptul de a solicita clarificări sau inf. suplim. în legătură cu documentaţia. În măsura în care solicitările de clarificare sunt primite cu cel puţin 20 zile înainte de termenul limită stabilit pentru depunerea candidaturilor, entitate contractantă va răspunde în mod clar si complet tuturor acestor solicitări de clarificare în a 11-a zi înainte de termenul stabilit pentru depunerea candidaturilor, in conformitate cu art. 173 din Legea 99/ 2016. EC va raspunde doar la solicitarile de clarificari adresate de operatorii economici pana la termenul limita stabilit . (conf prev art. 29 alin (3) din HGR).
Cantitatile minime/maxime estimate sunt prevazute in Anexa 3 – cantitati minime/maxime, atasata prezentei documentatii.

Se vor încheia 4 acorduri cadru, cate unul pe fiecare lot, cu maxim 30 op ec, cu o durata de 36 de luni calend, cu op. ec indeplinesc cerintele de calificare si cerintele din doc. descriptiva/spec. teh. si anexele acestuia Entitatea contractanta nu doreste limitarea numarului de candidati. Toti candidatii care indeplinesc cerintele de calificare vor fi calificati pentru etapa a II-a a procedurii. Daca doi sau mai multi ofertanti vor obtine acelasi punctaj, se va solicita ofertantilor transmiterea unei noi oferte de pret, în vederea departajarii ofertelor, iar atribuirea se va face conform criteriului din documentantia de atribuire. Documentul DUAE va fi completat in SEAP în mod direct, după autentificare, de către fiecare participant, avand posibilitatea printarii DUAE, si depunerii ei la adresa si ora mentionata in anuntul de participare. In conformitate cu art. 129 alin. (1) din HG nr. 394/2016, privind confidentialitatea, ODATA CU DEPUNEREA ORICAROR DOCUMENTE,OPERATORII VOR DECLARA CARE DIN DOCUMENTELE DEPUSE (SAU, DUPA CAZ, PARTI DIN DOCUMENTELE DEPUSE) SUNT CONFIDENTIALE. In cazul in care documentele nu au fost declarate confidentiale, se vor aplica prevederile art. 231, alin. 6 din Legea 99/2016 astfel cum sunt prevazute. In cazul in care se vor declarat documente ca fiind confidentiale sunt aplicabile prevederile art. 70 alin (4) din Legea nr. 99/ 2016: "informaţiile indicate de operatorii economici ca fiind confidenţiale, inclusiv secrete tehnice sau comerciale şi elementele confidenţiale ale ofertelor, trebuie să fie însoţite de dovada care le conferă caracterul de confidenţialitate, în caz contrar nefiind aplicabile prevederile alin. (1)" respectiv "Fără a aduce atingere celorlalte prevederi ale prezentei legi sau dispoziţiilor legale privind liberul acces la informaţiile de interes public ori ale altor acte normative care reglementează activitatea entităţii contractante, entitatea contractantă are obligaţia de a nu dezvălui informaţiile transmise de operatorii economici indicate de aceştia ca fiind confidenţiale, inclusiv secrete tehnice sau comerciale şi elementele confidenţiale ale ofertelor." Solicitarile de clarificari transmise din partea operatorilor economici inainte de ora 16:00 vor fi inregistrate la registratura entitatii contractante in aceeasi zi (ziua transmiterii), solicitarile de clarificari transmise dupa ora 16:00 vor fi inregistrate la registratura entitatii contractante in urmatoarea zi lucratoare. Avand in vedere ca procedura de achizitie se desfasoara in doua etape, EC solicita ca in prima etapa – de depunere a solicitarilor de participare, sa depuna doar urmatoarele documente:
- Formularul DUAE completat cu toate informatiile solicitate prin documentatia de atribuire (pentru fiecare candidat/asociat/subcontractant/terti sustinatori);
- Acordul de asociere (daca este cazul);
- Acordul de subcontractare (daca este cazul);
- Angajamentul de sustinere (daca este cazul);
- Declaratie privind neincadrarea in situatiile prevazute la art. 73 din Legea nr. 99/2016 privind achizitiile sectoriale – Formular 3 (pentru fiecare candidat/asociat/ subcontractant/terti sustinatori);
Informatii privind asociatii (daca este cazul) – conf. art. 199 din Legea 99/2016: In cazul in care un grup de operatori economici se asociaza pentru a depune o solicitare de participare comuna, acestia trebuie sa indeplineasca individual cerintele privind eligibilitatea si inregistrarea si, prin cumul, cerintele privind capacitatea tehnica si/sau profesionala, precum si cele privind situatia economica si financiara. Toate cerintele care nu se refera la capacitatea tehnica si/sau profesionala, si capacitatea economica si financiara, trebuie indeplinite individual de catre fiecare asociat. Candidatul, in cazul in care este format dintr-o asociatie la care participa mai multi operatori economici, va semna o declaratie prin care se obliga ca in cazul in care oferta sa este declarata castigatoare va legaliza asocierea, iar contractul de asociere legalizat va fi prezentat entitatii contractante, inainte de data semnarii acordului cadru. Se va depune acord de asociere cu indicarea procentului si a activitatilor care vor fi indeplinite de fiecare asociat. De asemenea se va desemna liderul asociatiei. Acordul de asociere se va depune odata cu documentul DUAE. Candidatii trebuie sa faca dovada ca vor indeplini toate cerintele solicitate, pentru executarea lucrarilor care fac obiectul acordurilor cadru, putand opta pentru asociere si eventual sustinere din partea unui tert. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE sunt solicitate tuturor candidatilor selectati inainte de transmiterea invitatiilor pentru etapa a doua a procedurii de atribuire.
Atribuirea contractelor subsecvente se realizeaza prin reluarea competitiei intre semnatarii acordului cadru si se face de 1/2 ori lunar sau tinand cont de necesitatile concrete a entitatii contractante, necesitatea fiind dictata de executarea lucrarilor de înlocuire conducte si racorduri si de realizarea de noi distributii de gaze naturale. Criteriul de atribuire la reofertare este: Cel mai bun raport calitate-pret, utilizand factorii descrisi la incheierea acordurilor cadru. Elementele care vor face obiectul reofertarii: pretul ofertei si termenul de garantie.Informatii privind cantitatile minime / maxime estimate de achizitionat, ale Acordului Cadru pentru fiecare lot se regasesc in Anexa 3- Cantitatile minime/ maxime estimate , pentru fiecare lot in parte, atasata prezentei documentatii. Valorile maxime estimate pe durata acordurilor cadru, pentru cel mai mare contract subsecvent, pentru fiecare lot in parte sunt prevazute in sectiunea II.2.4 Descrierea achizitiei publice din Fisa de date.
Metodologia de întocmire și evaluare a ofertelor prezentate: Ofertantul va completa în tabelul centralizator de ofertare (Anexa 2) contravaloarea punctului, ținând cont de explicitarea articolelor (din Anexa 2 B).
La ofertare Executantul va oferta valoarea unitară a unui punct, care înmulțită cu valoarea punctelor va avea ca rezultat prețul unitar (în lei) cu care Executantul va executa articolul respectiv.
Înmulțind cantitatea pe articol cu prețul unitar rezultă valoarea ofertei pe fiecare articol.
Suma valorilor articolelor dă ca rezultat valoarea ofertei care nu trebuie să depașească valoarea bugetului alocat pentru fiecare lot.
Ofertele care nu respectă aceasta cerință vor fi considerate neconforme. Nota: În cazul in care un Ofertant depune oferte pe mai multe loturi, aceste pot fi diferite ca prețuri ofertate în Anexa la formularul de oferta sau ca valoare a punctului stabilit în Anexa 2. In conf cu articolul 66 din Legea nr. 99/2016 privind ach. sect, cu modificarile si completarile ulterioare: (1) Au dreptul de a participa la procedurile de atribuire prevăzute la art. 82 alin. (1), în oricare dintre calitățile de ofertant/candidat/terț susținător/subcontractant, operatorii economici definiți la art. 3 alin. (1) lit. ii). (2) EC exclude din procedura de atribuire orice pers. fizică sau juridică, având calitatea de candidat individual/candidatt asociat/candidat/terț susținător/subcontractant, care nu se încadrează în definiția de la art. 3 alin. (1) lit. ii), fără a mai fi necesară verificarea încadrării în prev. art. 177, 178 și 180.” Info privind tertul sustinator (daca este cazul): In conf cu art.202 alin (2) din legea 99/2016, in cazul în care op ec demonst. Îndepl. criteriilor ref.e la situatia ec. si fin. ori privind capac. teh. si prof. bazându-se pe capac. altor entitati, invocând, dupa caz, sustinerea unui tert, DUAE, împreuna cu angaj. de sust., trebuie sa fie completat separat si de catre tertul sustinator.In conf cu art.197 din LG 99/2016, EC verifica daca tertul care asig. sustinerea în ceea ce priveste îndepl. crit. Ref. la situatia ec. si fin. ori privind capac. teh si/sau prof. îndeplineste crit. relevante privind capac., si nu se încadreaza în motivele de excl. prev la art. 177,178 si 180. Daca tertul nu îndepl. criteriile relevante privind capac. sau se încadr. în unul dintre motivele de excl. prev. la art.177,178 si 180, EC solicita, o singura data, ca op ec sa înlocuiasca tertul sust. fara ca acest aspect sa aduca atingere princ.trat. egal prevazut la art.2 alin.
