DescriptionThe Danish Ministry of Defence Acquisition and Logistics Organisation (DALO) has entered into a contract on 11 December 2025 with Lockheed Martin Global, Incorporated, (Lockheed Martin), concerning the acquisition of Fixed Air Defence Radars (FADR), including support for sustainment and training. The contract covers the acquisition of three FADRs to be installed at different sites across the Kingdom of Denmark, and an option for DALO to procure one additional FADR. The contract is divided into two agreements: 1) a contract regarding the delivery and installation of the FADRs (the Acquisition Contract), and 2) a framework agreement (the Sustainment Agreement) regarding support for sustainment (spare parts, repair services and technical support) and training for a period of up to 25 years The overall purpose of the acquisition is to replace and expand the existing radar capacity thereby improving and expanding airspace surveillance over the Kingdom of Denmark. To protect the essential interests of Denmark’s security, the contract has been awarded directly to Lockheed Martin pursuant to Article 346(1)(b) of the Treaty on the Functioning of the European Union (TFEU), following a limited competitive process.

Other information about renewalsThe contract covers both an Acquisition Contract and a Sustainment Agreement. The ordinary duration of the Sustainment Agreement is seven years. The Sustainment Agreement can be renewed twice for six years, followed by two additional renewals of three years, thus a total of up to 18 years, resulting in a maximum duration of 25 years. The Acquisition Contract will in general be in force until the supplier has fulfilled all its obligations under this contract, namely the delivery and installation of the FADRs.

Other justificationIt is DALO's assessment that the contract could be awarded directly (without a tender procedure) for the protection of the essential interests of Denmark’s security, pursuant to Article 346(1)(b) of the Treaty on the Functioning of the European Union (TFEU). The justification for awarding the contract directly in accordance with Article 346(1) (b) TFEU is, in particular, the following: The FADRs are military equipment which fall within the scope of the Council’s list from 15 April 1958, see also recital 10 of Directive 2009/81/EC, and the other services and supplies to be procured under the contract are directly related to the FADRs. The FADR capability protects the essential interests of Denmark’s security, as the FADRs constitute a core element of Denmark’s air surveillance and inter alia contribute to the detection, identification and tracking of airborne threats. The capability is thus essential to the effective functioning of Denmark’s national air defence and Denmark’s contributions to NATO’s integrated and coordinated air defence. In light of the extremely time-critical operational need to improve and expand the surveillance capabilities, the acquisition could not be effectively carried out by any measures other than a direct award of the contract as a public tender procedure would not be capable of meeting the required timeline. Furthermore, DALO needed – compared to a public tender procedure – greater flexibility in the structuring of the competition, including the ability, in step with the rapidly evolving geopolitical security situation, to continuously adapt the competition material applied, including the criteria for the award of the contract. The competition in the civilian market will not be adversely affected, inter alia because the procurement was organised in a manner ensuring the highest possible degree of openness and competition under the circumstances, through a limited competitive process between two suppliers. It is DALO’s assessment that the duration of the Sustainment Agreement of 25 years is justified by special circumstances, primarily in the light of the expected service life of the FADRs and the technical difficulties that may arise from a change of supplier.
