(X. 30.) Korm. rendelet 46. § (3) bekezdése alapján Ajánlatkérő az ajánlati felhívásban és a közbeszerzési dokumentumokban meghatározott gyártmányú, eredetű, típusú dologra, eljárásra, tevékenységre, személyre, illetőleg szabadalomra vagy védjegyre hivatkozhat. Minden ilyen esetben a megnevezés csak a tárgy jellegének egyértelmű meghatározása érdekében történt, ajánlatot jelen ajánlati felhívásban előírt, vagy az azzal – az adott termék vonatkozásában a részletes műszaki paraméterek tekintetében – egyenértékű termékre lehet tenni. A műszaki tartalom értékelése során az egyenértékűséget Ajánlatkérőnek kell megítélni, amely eldöntéséhez minden adatot ajánlattevőnek kell megadnia. Ajánlattevő kötelessége tehát annak bizonyítása az ajánlatban, hogy a megajánlott termék az Ajánlatkérő által meghatározott termékkel egyenértékű. Az esetleges el nem fogadást Ajánlatkérő tényszerűen megindokolja. Ajánlatkérő számára az előírtaknál kedvezőbb jellemzőkkel rendelkező termékre is tehető ajánlat. Nyertes AT feladatát képezi a beszerzésre kerülő eszközök üzembe helyezése. AK kizárólag új termékeket fogad csak el. AK „új” alatt, még nem használt, kereskedelmi forgalomba még nem hozott, kiállításokon és próba eszközként nem használt termékeket ért. Az ajánlathoz AT-nek csatolni szükséges a jelen közbeszerzési dokumentumok önálló mellékletét képező EXCEL fájlban kiadásra kerülő kitöltött (szakmai ajánlat). Az ajánlathoz AT-nek csatolni szükséges a jelen közbeszerzési dokumentumok önálló mellékletét képező WORD fájlban kiadásra kerülő kitöltött specifikációs táblázatot a szakmai paraméterekről, melyben meg kell adni többek között a megajánlott termék nevét, típusát, gyártóját, a származási helyét. AK felhívja AT-k figyelmét a Kbt. 74. § (3) bek.-re. Ajánlatkérő az ajánlatokat a legalacsonyabb ár értékelési szempontja (Ajánlati ár mindösszesen (nettó HUF)) szerint [Kbt. 76. § (2) bekezdés a) pont] bírálja el. Ennek szempontjai és a hozzájuk tartozó súlyszámok közbeszerzési részenként az alábbiak: Értékelési szempont: A Kbt. 76. § (2) bek. a) pont szerinti legalacsonyabb ár. A 76. § (5) bekezdés szerint AK számára a beszerzés tárgyát képező áruk csak valamely konkrétan meghatározott minőségi és műszaki követelménynek felelnek meg és a gazdaságilag legelőnyösebb ajánlat kiválasztását az adott esetben további minőségi jellemzők nem, csak a legalacsonyabb ár értékelése szolgálja. A teljesítési határidő: 120 naptári nap. Nyertes AT jogosult előteljesíteni. Nyertes AT jogosult az előteljesítés során legfeljebb 2 részletben teljesíteni, azonban a két részben történő teljesítés nem haladhatja meg a 120 naptári napot. A szerződés nem meghosszabbítható. Az EKR-ben továbbított dokumentumokkal, az EKR-ben elektronikus úton megtett nyilatkozatokkal szemben támasztott követelményekkel, illetve a képviselettel kapcsolatos előírásokat az elektronikus úton megtett nyilatkozatokkal kapcsolatban a Kbt. 40-41/C §-a az irányadó. 4. Közös ajánlattétel esetén a Kbt. 35.§-ban és a Kbt. 41/A. § (5) bekezdésben foglaltak szerint kell eljárni, továbbá az ajánlathoz csatolni kell a közös AT-k erre vonatkozó megállapodását. 5. AK gazdálkodó szervezet alapítását kizárja mind AT, mind közös AT-k vonatkozásában. 6. Kiegészítő tájékoztatás a Kbt. 56. § alapján. AK konzultációt, helyszíni bejárást nem tart. 7. AK jelen eljárásban előírja a Kbt. 25. § (3)-(4) és a 66. § (6) és a 65. § (7) bek. szerinti nyilatkozat ajánlatban történő feltüntetését (nemleges nyilatkozat is). 8. Hiánypótlás a Kbt. 71. §-ban foglaltaknak megfelelően, AK nem alkalmazza a Kbt. 71. § (6) bekezdés szerinti korlátozást. 9. AK alkalmazza a Kbt. 75. § (2) bekezdés e) pontját, valamint a Kbt. 81. § (5) bekezdését. 10. Amennyiben AT ajánlata részeként valamely dokumentumot nem magyar nyelven nyújt be, abban az esetben az ajánlatában benyújtott idegen nyelvű irat, valamint annak magyar fordítása vonatkozásában AT-nek nyilatkoznia kell, hogy a magyar fordítás mindenben megegyezik az eredeti nyelvű dokumentummal. 11. Amennyiben AT a Kbt. 69. § (11) bekezdése szerint kíván tényt vagy adatot igazolni, nem magyar nyelvű nyilvántartás esetén köteles a releváns igazolás vagy információ magyar nyelvű fordítását benyújtani; 12. Az ajánlatnak tartalmaznia kell AT, illetőleg a kapacitást nyújtó szervezet esetében az ajánlatban bármilyen nyilatkozatot aláíró személy aláírási címpéldánya vagy a cégnyilvánosságról, a bírósági cégeljárásról és a végelszámolásról szóló 2006. évi V. tv. 9. § (1) bek. szerinti aláírási-mintája. 13. AK a Kbt.45.§(1)bek. alkalmazása tekintetében munkaidőnek az alábbi időszakokat tekinti: hétfőtől csütörtökig, 10-15 óráig, pénteken, és amennyiben a szombati nap munkanap, szombaton 10-14 óráig terjedő időintervallum. 14. AK az alkalmasság megállapításához szükséges pénzügyi adatokat – annak szükségessége esetén – a Magyar Nemzeti Banknak, a felhívás feladásának napján érvényes hivatalos deviza középárfolyamai alapján számítja át Magyar Forintra. 15. Eljárással kapcsolatos valamennyi határidővel kapcsolatban a közép-európai idő az irányadó. A felhívásban nem szabályozott kérdések vonatkozásában a közbeszerzésről szóló 2015.évi CXLIII. törvény és végrehajtási rendeleteinek előírásai szerint kell eljárni. 16. FAKSZ: dr. AT-nek nyilatkoznia kell az ukrajnai helyzetet destabilizáló orosz intézkedések miatt hozott korlátozó intézkedésekről szóló 833/2014/EU tanácsi rendelet 5k. cikk (1) bekezdése szerinti tilalomról. 18. AT-nek ajánlata részeként be kell nyújtani a specifikációs táblázatot, melyben meg kell adnia az általa megajánlott eszköz műszaki paramétereit, a nevét, típusát, a gyártóját és származási helyét. 19. AT-nek ajánlata részeként be kell nyújtania az általa megajánlott terméke tekintetében a magyar nyelvű gyártói katalógust, vagy termékleírást, vagy bármely egyéb gyártó által kiállított dokumentumot, vagy a forgalmazótól származó nyilatkozatot vagy egyéb, a gazdasági szereplők számára szabadon hozzáférhető tanúsítást vagy igazolást. 20. AK abban az esetben biztosítja a specifikációs táblázat, a magyar nyelvű gyártói katalógus, vagy termékleírás vagy bármely egyéb gyártó által kiállított dokumentum, vagy a forgalmazótól származó nyilatkozat, vagy egyéb, a gazdasági szereplők számára szabadon hozzáférhető tanúsítás, vagy igazolás tekintetében a Kbt. 71. §-a szerinti hiánypótlást, amennyiben az ajánlat részeként benyújtott valamely dokumentumból beazonosítható a megajánlott eszköz/berendezés. Amennyiben az ajánlat részeként benyújtott egyik dokumentumból sem beazonosítható a megajánlott eszköz/berendezés, abban az esetben Ajánlatkérő a benyújtott ajánlatot a Kbt. 73. § (1) bekezdés e) pontja alapján érvénytelennek nyilvánítja. Tehát a fent felsorolt dokumentumok olyan hiánya, hibája tekintetében, mely alapján a megajánlott eszköz nem beazonosítható, AK a hiánypótlást kizárja és az az ajánlat Kbt. 73. § (1) bekezdés e) pontja szerinti érvénytelenségét vonja maga után! 21. AK szakmai ajánlatnak jelöli meg a kereskedelmi ajánlatot. AK felhívja a figyelmet, hogy annak teljes hiánya nem hiánypótolható hiányosság. A kereskedelmi ajánlat egészének be nem nyújtása az ajánlat Kbt. 73. § (1) bekezdés e) pontja szerinti érvénytelenségét vonja maga után! 15. rész: Döntés időpontja: 2025.12.23. A 15 - 15. MI Labor részt a Kbt. 75. § (1) bekezdés a) pontja alapján eredménytelen, tekintettel arra, hogy az ajánlattételi határidő lejártáig (2025. év augusztus hónap 12. napja 12 óra 00 perc) nem nyújtottak be ajánlatot.
