O udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy nie podlegają wykluczeniu z udziału w postępowaniu na podstawie art. 108 ust. 1 ustawy, art. 109 ust. 1 pkt 6, 7, 8 i 10 ustawy oraz na podstawie art. 7 ust. 1 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz służących ochronie bezpieczeństwa narodowego oraz na podstawie art. 5k rozporządzenia Rady (UE) nr 833/2014 z dnia 31 lipca 2014 r. dotyczącego środków ograniczających w związku z działaniami Rosji destabilizującymi sytuację na Ukrainie. Zamawiający mając na uwadze regulacje ustawy z dnia 09.07.2025 r. o zmianie ustawy – Prawo zamówień publicznych oraz ustawy o umowie koncesji na roboty budowlane lub usługi, określa szczególne postanowienia, o których mowa w Rozdziale IV i VII SWZ dotyczące „państw trzecich”. 4. O udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy spełniają warunki udziału w postępowaniu dotyczące: 4.1. uprawnień do prowadzenia określonej działalności gospodarczej lub zawodowej, o ile wynika to z odrębnych przepisów: Wykonawca musi być wpisany do rejestru przedsiębiorców telekomunikacyjnych na podstawie ustawy z dnia 12 lipca 2024 r. Prawo komunikacji elektronicznej; 4.2. zdolności technicznej lub zawodowej. Wykonawca w okresie ostatnich trzech (3) lat, a jeżeli okres prowadzenia działalności jest krótszy – w tym okresie: a) Dla części zamówienia nr 4-17,19-30: należycie wykonał lub wykonuje co najmniej jedną (1) usługę przesyłu danych z wykorzystaniem łącza telekomunikacyjnego E1, a każda z usług świadczona była/jest nieprzerwanie przez okres co najmniej dwunastu (12) kolejnych miesięcy. Usługi muszą być świadczone w różnych relacjach; b) Dla części zamówienia nr 4-17, 31, 33 należycie wykonał lub wykonuje co najmniej jedną (1) usługę przesyłu danych z wykorzystaniem łącza telekomunikacyjnego xWDM, a usługa ta świadczona była/jest nieprzerwanie przez okres co najmniej dwunastu (12) kolejnych miesięcy. c) Dla części zamówienia nr 1-3, 18, 32: należycie wykonał lub wykonuje co najmniej jedną (1) usługę przesyłu danych z wykorzystaniem łącza telekomunikacyjnego Ethernet, a usługa ta świadczona była/jest nieprzerwanie przez okres co najmniej dwunastu (12) kolejnych miesięcy. Wykaz oświadczeń i dokumentów, jakie mają złożyć wykonawcy w celu potwierdzenia spełniania warunków udziału w postępowaniu oraz niepodlegania wykluczeniu z udziału w postępowaniu zawarte są w rozdziale VII SWZ. 5. Wykonawcy mogą wspólnie ubiegać się o udzielenie zamówienia zgodnie z art. 58 ustawy. 6. Zamawiający nie wymaga wniesienia wadium. 7. Dokumentacja zamówienia (w tym zmiany i wyjaśnienia treści SWZ oraz inne dokumenty) została zamieszczona na Platformie zakupowej Marketplanet (dalej: Platforma), na stronie prowadzonego postępowania. Szczegółowa instrukcja korzystania z Platformy, w tym rejestracja, logowanie, składanie zapytań i wniosków oraz składanie ofert, zmiana czy wycofanie oferty, dostępna jest pod adresem https://pansa.ezamawiajacy.pl/ w zakładce „Baza Wiedzy”, a także na stronie internetowej https://oneplace.marketplanet.pl/regulamin. Korzystanie z Platformy przez Wykonawcę jest bezpłatne. 8. Zalecenia Zamawiającego odnośnie kwalifikowanego podpisu elektronicznego: - dla dokumentów w formacie „pdf” zaleca się podpis w formacie PAdES, - dokumenty w formacie innym niż „pdf” zaleca się podpisywać formatem XAdES. 9. Zamawiający dopuszcza formaty przesyłanych danych, tj. pojedynczych plików o wielkości do 2GB w formatach dopuszczalnych rozporządzeniem Rady Ministrów z dnia 21 maja 2024 r. w sprawie Krajowych Ram Interoperacyjności, minimalnych wymagań dla rejestrów publicznych i wymiany informacji w postaci elektronicznej oraz minimalnych wymagań dla systemów teleinformatycznych. Szczegółowe wymagania techniczne dla dokumentów elektronicznych zawarte są w SWZ. 10. Reprezentacja i pełnomocnictwo. W celu potwierdzenia, że osoba działająca w imieniu Wykonawcy jest umocowana do jego reprezentowania, Zamawiający żąda od Wykonawcy odpisu lub informacji z Krajowego Rejestru Sądowego, Centralnej Ewidencji i Informacji o Działalności Gospodarczej lub innego właściwego rejestru - szczegóły wymagań zawarte w Rozdziale VII pkt 6 SWZ. 11.Jednocześnie, działając na podstawie art. 133 ust. 3 w związku z art. 65 ust. 1 pkt 6) ustawy z dnia 11 września 2019 r. Prawo zamówień publicznych, zwanej dalej „ustawą” oraz z uwagi na ochronę poufnego charakteru informacji zawartych w SWZ oraz poufnego charakteru miejsc i urządzeń prezentowanych podczas wizji lokalnej, Zamawiający informuje, że utajniony Załącznik nr 1 do SWZ – pn.: „Szczegółowy opis przedmiotu zamówienia” (dalej: OPZ) zostanie udostępniony, po podpisaniu przez uprawnione osoby Oświadczenia o zachowaniu poufności (wg Załącznika nr 10 do SWZ).
