Information about review deadlines: Zuständige Stelle, an die sich der Bieter zur Nachprüfung behaupteter Verstöße gegen die Vergabebestimmungen wenden kann (Vergabekammer i.S.d. § 104 GWB) ist seit dem 01.01.2026 ist die Vergabekammer Westfalen. Die SBO weist darauf hin, dass ein Nachprüfungsantrag nur zulässig ist, soweit 1. der Antragsteller den gerügten Verstoß gegen Vergabevorschriften im Vergabeverfahren erkannt hat, er diesen gegenüber der Vergabestelle innerhalb einer Frist von 10 Kalendertagen gerügt hat, 2. der Antragsteller Verstöße gegen Vergabevorschriften, die aufgrund der Bekanntmachung erkennbar sind, spätestens bis zum Ablauf der in der Bekanntmachung benannten Frist zur Bewerbung oder zur Angebotsabgabe gegenüber der Vergabestelle gerügt hat, 3. der Antragsteller Verstöße gegen Vergabevorschriften, die erst in den Vergabeunterlagen erkennbar sind, spätestens bis zum Ablauf der Frist zur Bewerbung oder zur Angebotsabgabe gegenüber der Vergabestellegerügt hat, 4. der Antrag auf Einleitung eines Nachprüfungsverfahrens innerhalb von 15 Kalendertagen nach Eingang der Mitteilung der Vergabestelle, einer Rüge nicht abhelfen zu wollen, gestellt wird.
