Justification for the accelerated procedure: RILEVATA l'assoluta necessità e urgenza di contrarre in tempi ulteriormente ridotti, quantificati in complessivi 23 giorni per la ricezione delle offerte, in forza delle seguenti motivate e oggettive ragioni di pubblico interesse: 1. Tassatività ed indifferibilità del servizio: Le prestazioni oggetto d'appalto riguardano il servizio di assistenza specialistica all'autonomia per alunni con disabilità e i servizi parascolastici del Comune di Iseo. Tali servizi rivestono carattere di essenzialità per la garanzia del diritto allo studio e devono essere inderogabilmente attivati ed operativi in concomitanza con l'avvio dell'Anno Scolastico 2026/2027, stabilito al 1° settembre 2026; 2. Tempi tecnici per la Clausola Sociale: L'Art. 15 del Capitolato d'Appalto impone all'operatore economico aggiudicatario l'obbligo di attivare le procedure di monitoraggio, esame e prioritario assorbimento occupazionale del personale impiegato dal gestore uscente. Tale adempimento richiede tempi tecnici di consultazione sindacale e passaggi di informazioni non comprimibili, da svolgersi necessariamente nel mese di agosto, al fine di scongiurare interruzioni del servizio o disservizi a danno dell'utenza fragile all'apertura delle scuole; 3. Rispetto dei termini dilatori: Si rende indispensabile concludere la fase di presentazione delle offerte entro il 26 luglio 2026 per consentire alla Commissione Giudicatrice lo svolgimento delle operazioni di valutazione delle offerte tecniche ed economiche, la successiva verifica di efficacia dei requisiti e il rispetto del termine dilatorio di standstill (pari a 32 giorni) prima della formale stipulazione del contratto o della consegna anticipata sotto riserva di legge.
