Bei der Überschreitung von als Vertragsfristen vereinbarten Einzelfristen ist Bezugsgröße derjenige Teil der Netto-Abrechnungssumme, der den bis zu diesem Zeitpunkt vertraglich zu erbringenden, abrechenbaren Leistungen entspricht. 2.2 Die Vertragsstrafe wird auf insgesamt 5 % der Netto-Abrechnungssumme begrenzt. Bei der Überschreitung von als Vertragsfrist vereinbarten Einzelfristen ist die Vertragsstrafe auf den in Satz 1 genannten Prozentsatz desjenigen Teils der Netto-Abrechnungssumme begrenzt, der den bis zu diesem Zeitpunkt vertraglich zu erbringenden, abrechenbaren Leistungen entspricht. Überschreitet der Auftragnehmer lediglich vereinbarte Einzelfristen, wird die Frist für die Vollendung der Leistung jedoch eingehalten, beträgt die maximale Vertragsstrafe 3% der berechtigten Netto-Abrechnungssumme. 2.3 Verwirkte Vertragsstrafen für den Verzug wegen Nichteinhaltung als Vertragsfristen vereinbarter Einzelfristen werden auf eine durch den Verzug wegen Nichteinhaltung der Frist für die Vollendung der Leistung verwirkte Vertragsstrafe angerechnet. 2.4 Die Vertragsstrafenregelung gilt ebenso im Falle einer Vereinbarung neuer von Ziff. 1 abweichender Vertragstermine. Einer neuen Vereinbarung der Vertragsstrafe bedarf es in diesem Fall nicht. 2.5 Der Auftraggeber kann sich die Geltendmachung der Vertragsstrafe bis zur Fälligkeit der Schlussrechnung vorbehalten. 2.6 Die Geltendmachung weiterer Schadensersatzansprüche bleibt neben der Vertragsstrafe unberührt. Jede verwirkte Vertragsstrafe wird auf solche Schadensersatzsprüche angerechnet."

Description: Im Süden soll das Gebäude um einen Anbau an das bestehende Bauteil F erweitert werden. Weiterhin wird ein Teil der Garagen aufgelöst und die dabei entstehenden Flächen der ZINA hinzugefügt. Im Erdgeschoss des unterkellerten Anbaus wird die neu zu schaffende Beobachtungsstation (Decision Unit) untergebracht. Der neue Anbau soll in Massivbauweise (Beton) konventionell errichtet werden.
