Description: De conformidad con el artículo 28 de la LCSP, el contrato que se propone es necesario para el cumplimiento y realización de los fines institucionales de la Confederación Hidrográfica del Segura, O.A. (en adelante CHS). La Dirección Técnica de la CHS gestiona, mantiene, conserva y explota 29 grandes presas de titularidad estatal, y diferentes balsas, clasificadas en su mayoría en Categoría A en función del riesgo potencial que pueda derivarse de su posible rotura o funcionamiento incorrecto. Las Normas Técnicas de Seguridad para las Presas y sus Embalses, aprobadas por RD 264/2021, de 13 de abril, constituyen la normativa vigente en materia de seguridad de presas y embalses de obligado cumplimiento, unificando en ella todas las prescripciones hasta ahora en vigor y dando fin a la situación de transitoriedad en la que coexistían distintas normas con diferentes exigencias y distintos niveles de seguridad. La Directriz Básica de Planificación de Protección Civil ante el Riesgo de Inundaciones, aprobada por acuerdo de Consejo de Ministros de 9 de diciembre de 1994 y publicada en el BOE de 14 de febrero de 1995, establece los requisitos mínimos sobre fundamentos, estructuras, organización, criterios operativos, medidas de intervención e instrumentos de coordinación que deben cumplir los Planes Especiales de emergencias por inundaciones. Ambas normativas establecen la obligatoriedad de clasificar las presas en función del riesgo potencial que pueda derivarse de una posible rotura o funcionamiento incorrecto de cada presa y que éstas serán clasificadas en función de los daños que puedan originar a las personas, núcleos urbanos, servicios esenciales, medio ambiente o bienes económicos.
