Da bei einer Prüfung, des Verzeichnisses der für allgemeinverbindlich erklärten Tarifverträge und einer Abfrage beim Ministerium für Arbeit, Soziales, Gesundheit und Gleichstellung Sachsen-Anhalt, kein tarifvertraglich vereinbartes Entgelt (Tariflohn) für die Leistung als maßgeblich zu erwarten ist,gilt: Das für diese Vergabe geltende Mindeststundenentgelt das der Auftragnehmer seinen Mitarbeitern mind. Zahlen muss, beträgt laut § 11 Abs. 3 TVergG derzeit 16,12 € und berechnet sich anhand der Entgeltgruppe 1 Erfahrungsstufe 2 (inklusive Jahressonderzahlungen im Tarifgebiet Ost) des Tarifvertrages des öffentlichen Dienstes der Länder durch die Anzahl der Arbeitstage im jeweiligen Jahr. 3. Gem. TVergG-LSA § 17, Abs. 1 kann der öffentliche Auftraggeber Kontrollen durchführen, um die Einhaltung der aufgrund des Gesetzes auferlegten Vertragspflichten des Auftragnehmers und seiner Nachunternehmer zu überprüfen. Die Kontrolle wird vertraglich vereinbart (siehe Pkt. 4 der Ergänzenden Vertragsbedingungen allgemein zum TVergG LSA) 4. Hinweis zum Datenschutz: Die vom Auftraggeber erbetenen Angaben werden im Rahmen des Vergabeverfahrens und der Auftragsdurchführung verarbeitet und gespeichert, die gesetzlichen Archivierungszeiträume eingeschlossen.
