Justification: Prilikom definiranja predmeta nabave naručitelj nije uzimao u obzir kriterije dostupnosti za osobe s invaliditetom(članak 208. stavak 1 Zakona o javnoj nabavi) budući da u planiranju nabave nije predviđeno da će predmet nabave koristiti osobe s invaliditetom. Naručitelj je prilikom planiranja nabave znao koje će točno osobe koristiti predmetnu opremu, a među njima nisu osobe s invaliditetom, a osobito nisu osobe koje imaju specifičn uinvalidnost za koju je potrebna prilagodba predmeta nabave.
