Additional information: La présente opération comprend 11 lots géographiques correspondant aux 11 aires territoriales (6 en secteur Bourgogne et 5 en secteur Franche-Comté). Un candidat peut se positionner sur un ou plusieurs lots de cette consultation, mais 2 lots au maximum seront attribuables par agence (SIRET). L’identité de l’agence qui réalisera la prestation et le numéro SIRET doivent être clairement mentionnés par lot dans la note méthodologique distincte par lot. L’Ordre d’attribution des lots sera effectué dans l’ordre suivants des lots : 03 ; 04 ; 05 ; 08 ; 09 ; 06 ; 10 ; 02 ; 11 ; 01 et 07. La durée de chaque accord-cadre est conclue pour une durée d’un an qui pourra faire l’objet de 3 reconductions tacites d’une durée d’un an chacune. La durée maximale de l’accord-cadre sera donc de 4 ans. La date prévisionnelle de début des missions de l’accord-cadre est fonction de l’échéance de l’actuel accord-cadre SPS grosses réparations en cours de validité jusqu’au 09/12/2026 : - NOVEMBRE 2026 pour les opérations nécessitant une mission de + de 3 mois hors garantie de parfait achèvement au-delà de l’échéance du 09/12/2026 ; - DECEMBRE 2026 pour les autres opérations. Estimation globale de l'accord-cadre sur les 11 lots : 270 000 € HT - Montant minimum et maximum de commandes : - minimum : La Région ne s’engage sur aucun minimum de commandes. Le titulaire n’aura donc aucun droit à indemnisation en l’absence de commandes. Aucune indemnité de dédit ne sera alors versée au titulaire. - Maximum : le montant maximum de commandes par lot s'élève à 200 000 € HT et représente la limite supérieure des obligations susceptibles d’être mises à la charge du titulaire par le biais de bons de commande. Conditions de remise des plis : il est précisé que la signature n'est pas obligatoire. Elle ne sera demandée qu'à l'attributaire de l'accord-cadre. Les candidats peuvent télécharger le DCE et doivent répondre exclusivement par voie électronique en utilisant de préférence la procédure DUME Simplifié, sur le site : https://marches.ternum-bfc.fr - référence : 2026-23S01-009. Modification(S) des marchés de la présente consultation : en application des articles L2194-1et 2 et R2194-1 à R2194-10 du CCP, des modifications pourront être apportées au contrat par l’acheteur. En application de l’article R2122-7 du CCP, un marché de prestations similaires pourra être conclu si nécessaire par l’acheteur. Préalable à la régularité de l’offre est conditionné aux éléments suivants : 1/ en application des art R4532-19 et R4533-1 du code du travail, le cumul des missions de maitrise d’œuvre et SPS est proscrit pour les travaux en accord-cadre de grosses réparations > à 760 000 €HT. Par conséquent, les titulaires de l’accord-cadre Etudes grosses réparations ne pourront pas soumissionner sur le présent accord-cadre SPS pour un même lot géographique dont ils sont titulaires, considérant que chaque lot comprend des travaux > et < au montant de 760 000 € HT sans distinction. 2/ Identification par lot, de 2 coordonnateurs SPS (joindre CV) confirmés de niveau 2 en application de l’article R4532-23 Code du Travail prévoyant que le niveau 2 de compétence est apte à coordonner les opérations de 2ème et 3ème catégorie ; 3/ Habilitation des 2 personnes physiques dédiées à l’exécution des missions SPS de niveaux 2 et 3, conformément aux articles R. 4532-23 à R. 4532-37 modifiés du Code du Travail par décret n°2011-39 du 10 janvier 2011 et décret n°2021-652 du 25 mai 2021 relatif aux compétences et à la formation des coordonnateurs de sécurité et de protection de la santé : - Expérience professionnelle en coordination SPS, OU Diplôme, dans les conditions suivantes : une expérience professionnelle en architecture, ingénierie ou maîtrise d'œuvre (phase conception) et en en matière de contrôle des travaux, d'ordonnancement, de pilotage et de conduite des travaux ou de maîtrise de chantier ou en tant que coordonnateur ou agent en matière de sécurité (phase réalisation) d'une durée minimale de cinq ans OU un diplôme, de niveau au moins égal à la licence professionnelle, en hygiène sécurité et environnement attestant de compétences dans le domaine de la construction, du bâtiment et des travaux publics (compétence de niveau 2) ; - Attestation de compétence en cours de validité et adaptée, d'une part, à l'expérience professionnelle ou au diplôme du candidat et, d'autre part, au niveau 2 de compétence, remise par l’organisme de formation certifié, des 2 personnes physiques dédiées à l’exécution des missions SPS, les habilitant à exercer les missions de coordonnateur SPS de niveau 2 pour les phases de conception et de réalisation. Critères d'attribution : - CRITERE 1 Qualité de la proposition appréciée au regard des sous-critères suivants (40%): * Sous-Critère 1 : Organisation du prestataire pour la réalisation des missions de la présente opération 20% * Sous-Critère 2 : Qualité des documents d'études : 20 % dont Exemple de Registre journal : 5% ; Exemple Plan Général de Coordination : 5% ; Exemple Dossier d’intervention ultérieur sur les ouvrages : 10 % - CRITERE 2 : cohérence du taux horaire (article 1 du BPU) proposé au regard des prescriptions techniques du CCTP (30 %) - CRITERE 3 : montant total mentionné au devis test de l’offre (30 %) En application de l’article R.2161-4 du code de la commande publique, la vérification des candidatures ne s’effectuera que pour les candidats qui devraient être attributaires des contrats-cadres. Critères de sélection des candidats : - Garanties financières : adéquation des capacités financières du candidat avec le montant prévisionnel de l’accord-cadre, appréciée au regard du dernier chiffre d’affaires dans le domaine d’activité faisant l'objet du présent accord-cadre. - Compétences et moyens : aptitude du candidat au regard de ses moyens globaux à répondre aux exigences du présent accord-cadre, et à assumer plusieurs missions concomitantes de SPS de niveaux 2 et 3, concernant des opérations de grosses réparations et/ou d’optimisations énergétiques dans des délais contraints, voire d’urgence, et en site occupé. - Compétences professionnelles : adéquation de l’expérience professionnelle des moyens humains globaux du candidat, appréciée au regard de l’adéquation des références présentées.
