The current bundles have been in service for approximately 25 years, and are an integrated part of the economizer part of the sludge incineration plant at Avedøre Wastewater Treatment PlantThis procurement is for: Design and build contract regarding replacement of the thermal oil bundles in the economizer part of the sludge incineration plant at Avedøre Wastewater Treatment Plant, including decommissioning of the current bundles. Main features of the procedureThe procurement will be carried out as a competitive procedure with negotiation in accordance with the Danish Public Procurement Act (Consolidated Act no. 10/ 2023, as amended) (Udbudsloven), cf. § 61(1)(c) as the contract cannot be awarded without prior negotiation due to special circumstances with regard to its complexity, including legal, financial and technical conditions and risks in connection with the contract.The competitive procedure with negotiation means that the process - in general - contains the following activities:On the basis of the Contract Notice, companies can apply for pre-qualification ("open round").On the basis of the prequalification applications received, 3 companies are prequalified.Only pre-qualified companies can submit tenders ("closed round").After the tender deadline has expired, the Contracting Authority may choose to award the contract on the basis of the initial tenders without negotiation. Additional informationThe Contracting Authority has decided not to divide the contract into lots. This decision is based on the complexity of the works, for which a single contractual arrangement is considered necessary to ensure effective project management and clear allocation of responsibility. Furthermore, the Contracting Authority considers that a single contract will represent a more attractive commercial opportunity and generate economies of scale, thereby increasing the likelihood of receiving a sufficient level of market interest and competition to ensure the best possible outcome for the procurement. Moreover, a single contract will reduce the number of interfaces between contractors and minimize the risks associated with coordination, integration and overall project delivery Is the economic operator established in a country that is included on the EU list of non-cooperative tax jurisdictions and has not acceded to the WTO Government Procurement Agreement or other trade agreements obliging Denmark to open the public procurement market to tenderers established in that country The contracting authority shall also exclude economic operators that are subject to EU sanctions under Article 5k of Council Regulation (EU) No 833/2014, as amended, concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine. 6.1 Questions All questions must be submitted via the e-Procurement Portal. Applicants are encouraged to submit any questions as soon as possible and no later than on the date set out in section 5. All questions (including questions received after the above "deadline") will be answered, to the extent that it is possible to come up with an answer no later than 6 calendar days before the deadline for request to participate. Applicants are encouraged to use the “Template for submitting questions” provided with the tender documents. The completed form may include one or more questions, but applicants are not allowed to add further questions once the form has been submitted to the Contracting Authority. Any further questions may be submitted subsequently using a new template for submitting questions. Questions and answers, as well as any amendment sheets, will be published to all applicants, in anonymized form, on the e-Procurement Portal. Means of proof: The tenderer in line to be awarded the Contract shall, upon request (not as part of the request for participation), submit a Certificate of Service (for Danish companies) or equivalent documentation (for foreign companies) as evidence that the Tenderer is not subject to any of the exclusion grounds referred to above. The Contracting Authority will accept Certificates of Service and equivalents issued no later than 6 months prior to the deadline for submission of final tenders. The reference list, which must be included in the ESPD as mentioned above, is considered by the Contracting Authority to be the final documentation of the Applicant's technical and professional ability. For applicants relying on the capacity of other entities to meet the minimum requirements, it is also a requirement that the Applicant, as part of the documentation, must submit a Declaration of support (Appendix D) or equivalent documentation demonstrating that the respective entity is legally bound to the Applicant.

DescriptionEvaluation of the sub-criterion “price”: The sub-criterion ‘price’ will be assessed on the basis of the answers provided by the Tenderer when filling in Appendix 5 – Tender List. The evaluation will be based on the Tenderer’s stated prices, exclusive of VAT, but inclusive of all other costs. The total evaluation price is automatically added up in Appendix 5 – Tender List. The evaluation model used for the sub-criterion ‘Price’ is described below. Primary evaluation model The total evaluation prices will be evaluated relatively and based on a linear score model from 0 – 10 points. The ‘lowest total evaluation price’ among the compliant tenders cf. Prequalification and Tender conditions section 7.6, is awarded 10 points. A total evaluation price equal to the ‘lowest total evaluation price’ plus X % or above will be awarded 0 points, however, subject to the use of the below secondary and tertiary evaluation models if the conditions for this have been met. Other total evaluation prices are awarded points based on the following formula: =( ℎ − )/ ℎ = − ∗ where X is thus set at 50 % If the following secondary or tertiary evaluation model is used, the above formula is adjusted accordingly.
