Description of the options: InnovationQuarter behoudt zich het recht voor om de volgende werkzaamheden die in het verlengde liggen van onderhavige opdracht aan opdrachtnemer op te dragen, mits deze werkzaamheden naar aard en omvang voldoende verband houden met de oorspronkelijke opdracht en passen binnen de doelstellingen van het project. In ieder geval wordt hieronder verstaan: beursdeelnames in andere werelddelen dan Europa en de Verenigde Staten. Indien de waarde van deze aanvullende werkzaamheden meer dan 50%van de oorspronkelijke inschrijfsom bedraagt, zal InnovationQuarter een nieuwe aanbestedingsprocedure starten, tenzij een uitzondering op grond van artikel 2.163 Aanbestedingswet 2012 van toepassing is. Deze clausule is bedoeld als een herzieningsbepaling in de zin van artikel 2.163c Aanbestedingswet 2012 en wordt geacht vooraf voldoende duidelijk, nauwkeurig en ondubbelzinnig te zijn geformuleerd. De toepassing van deze clausule laat de beginselen van transparantie, proportionaliteit en gelijke behandeling onverlet.

Justification for the duration of the framework agreement: InnovationQuarter wijkt af van de maximale looptijd van vier jaar voor raamovereenkomsten en kiest voor een langere looptijd van in totaal maximaal acht (8) jaar. Deze langere looptijd is objectief gerechtvaardigd gelet op het specifieke karakter van de opdracht en de investeringen die van de opdrachtnemer worden gevraagd. De opdracht betreft het ontwerp, de realisatie en de logistieke organisatie van internationale beursstands. InnovationQuarter streeft daarbij naar het gebruik van modulaire en herbruikbare standbouwsystemen om duurzaamheid te bevorderen en afvalstromen te beperken. Een langere contractduur stelt de opdrachtnemer in staat om te investeren in duurzame materialen en deze gedurende meerdere beurscycli in te zetten, waardoor de milieubelasting afneemt en schaalvoordelen ontstaan. Daarnaast leidt een langdurige samenwerking tot efficiëntere werkprocessen. De opdrachtnemer bouwt gedurende de looptijd specifieke kennis op van de wensen en werkwijze van InnovationQuarter, de toepassing van NL-branding, de doelstellingen van de verschillende beursdeelnames en de eisen van internationale beursorganisaties. Hierdoor kan sneller en effectiever worden samengewerkt, worden voorbereidingskosten beperkt en neemt de kwaliteit en consistentie van de beursdeelnames toe. Gezien het strategische karakter van de opdracht, het beperkte aantal geschikte marktpartijen en de benodigde investeringen in materialen, processen en kennisopbouw is een looptijd van maximaal acht jaar proportioneel en noodzakelijk om de beoogde doelstellingen op het gebied van kwaliteit, duurzaamheid, continuïteit en kostenefficiëntie te realiseren.
