Information about review deadlines: Gemäß § 160 GWB leitet die Vergabekammer ein Nachprüfungsverfahren nur auf Antrag ein. Antragsbefugt ist jedes Unternehmen, das ein Interesse am Auftrag hat und eine Verletzung in seinen Rechten (§ 97 Abs. 6 GWB) durch Nichtbeachtung von Vergabevorschriften geltend macht. Dabei muss das Unternehmen darlegen, dass ein Schaden entstanden ist oder dieser zu entstehen droht. Gemäß § 160 Abs. 3 GWB müssen erkannte Verstöße innerhalb einer Frist von 10 Kalendertagen bei der Stadt Oldenburg gerügt werden. Verstöße gegen Vergabevorschriften, die sich aus diesem Bekanntmachungstext oder aus den Vergabeunterlagen ergeben, müssen innerhalb der Angebotsfrist gerügt werden. Hilft die Stadt Oldenburg der Rüge nicht ab, kann ein Antrag auf Nachprüfung bei der Vergabekammer innerhalb von 15 Kalendertagen nach Eingang der Mitteilung der Stadt Oldenburg, der Rüge nicht abhelfen zu wollen, gestellt werden. Der Nachprüfungsantrag ist allerdings unzulässig, wenn die genannten Fristen nicht eingehalten wurden (§ 160 Abs. 3 GWB). Darüber hinaus ist ein Nachprüfungsantrag unzulässig, wenn der Antrag erst nach Zuschlagserteilung zugestellt wird (§ 168 Abs. 2 GWB).
