The procurement is for the procurement of an operational control system within W&S, including installation of the necessary equipment, and it is being carried out in accordance with the utilities regulation part II. The main contract element is the delivery of software that shall be installed on-prem at the customer. This part of the delivery is considered to have limited climate and environmental impact. The most relevant environmental conditions in the procurement are therefore connected to the physical parts of the delivery, including transport, installation work, emissions from vehicles, return of equipment and packaging, as well as waste handling. The contracting authority estimates that climate and environmental considerations in this procurement are clearly best taken care of through concrete and binding minimum requirements in the requirement specifications and contract, rather than as a separate award criterion. The background is that the significant environmental impacts can be identified in advance and regulated directly through requirements that all tenderers must fulfil. There are, therefore, minimum requirements for vehicles used during the delivery, including requirements for EURO class 6/STEG IV and that class B vehicles shall be zero emission vehicles. In addition there are requirements for reliable handling of returns, packaging and minimum requirements for source sorting. The requirements are made to contractual obligations and can be followed-up in the execution of the contract. Based on this, the contracting authority considers that concrete environmental requirements will give a clearly better environmental effect than an evaluation of climate and the environment as the award criteria.

Justification for the duration of the framework agreement: The contracting authority considers that there are special conditions that suggest that the framework agreement's length should exceed the main rule of eight years in the utilities regulations § 22-1 (4). The supply regulations explicitly open for this, when, among other things, the contract ́s purpose, investment costs or the users ́needs make it necessary. In this procurement, the framework agreement is for operational control systems and PLC systems, which are a part of the critical infrastructure for water/sewage. This type of system has a technical and operational character that separates them from normal IT systems and other standardised systems. There are several conditions that, in total, mean that a longer contract period is both proportionally, necessary and socially justifiable. 1. Considerable investments and a need for depreciation over a long period of time. The implementation of operational control systems and PLS systems requires: · comprehensive software and licence costs · complex integrations with existing installations, PLCs, sensors and communication infrastructure. · adaptations, testing, redundancy set up and security functions These are investments that normally have to be written off over more than eight years in order to be financially justifiable. The supply regulations allow a longer agreement when investment costs make it necessary. 2. High costs and risks of supplier changes. The systems have a high complexity and major consequences in the event of an error. A change of supplier involves significant risk, including: · operational interruptions in critical infrastructure · alterations to entire control room systems. · training of operational personnel · security risks from migration of historical data, alarms and control functions. 3. Technological lifetime and long term security need The systems are a part of social critical infrastructure. Stability, continuity and cyber security require: · long-term updating course · predictable patch and maintenance strategy · dedicated supplier follow-up · robustness in supplier relation. The actual technical lifetime of the systems can be 15-20 years, and a short framework agreement will involve more frequent procurements of goods - which is not compatible with the requirements on proportionality and resource use in the procurement regulations. 4. Need for continual development and adaptation. The supply sector is facing: · increasing digitalisation · stricter security requirements · new regulatory requirements (e.g. connected to the NIS directive) · increased automation An operational control system must be continually developed throughout its life cycle. A framework agreement for a longer length is therefore necessary to ensure: · the tenderer's long-term obligation · consistent developments. · avoidance of fragmented parallel solutions Conclusion Based on the systems ́ technical complexity, considerable investment costs, high replacement costs, critical social function and the need for continual security follow-up, the Contracting Authority considers special conditions in accordance with the Utilities Regulation § 22-1 (4), which justifies that the framework agreement period is set beyond the main rule of eight years. This duration will be seen as: · proportionally · necessary · in accordance with the rules ́ opening for an extended framework agreement period for special conditions
