Other justification: Gemäß § 3a Abs. 1 VOB/A EU stehen dem öffentlichen Auftraggeber nach seiner Wahl das offene und das nicht offene Verfahren zur Verfügung. Die anderen Verfahrensarten stehen nur zur Verfügung, soweit dies durch gesetzliche Bestimmungen oder nach den Absätzen 2 bis 5 gestattet ist. § 3a Abs. 3 und § 3b VOB/A EU regelt dabei, dass das Verhandlungsverfahren ohne Teilnahmewettbewerb unter anderem dann zulässig ist, wenn die Leistungen aufgrund nicht vorhandenen Wettbewerbs aus technischen Gründen nur von einem bestimmten Unternehmen erbracht werden können. Eine solche Situation ist in dem vorliegenden Fall gegeben. Für die Leistungen der Leit- und Sicherungstechnik im Projekt O128 – Kapazitätserweiterung Bahnhof Käfertal ist kein Wettbewerb vorhanden, da es sich um keinen Neubau, sondern um (umfangreiche) Anpassungen der Bestandsanlagen handelt. Aufgrund des geringen Anlagenalters der Bestandsanlage sollen größtenteils die Elemente der Außenanlage wie Signale, Gleisschaltmittel, Weichenantriebe weiterverwendet werden. Die Herstellung der Anpassungen / Umbau der Bestandselemente kann und darf nur der Hersteller Alstom (ehemals Bombardier Transportation) vornehmen. Andere Hersteller müssten umfangreiche Schnittstellen zum Bestandssystem herstellen, welche eine erneute Grundzulassung des Systems bei den Behörden notwendig machen würde, welche aus Zeitgründen nicht darstellbar ist und letztlich kein wirtschaftliches Angebot zulässt. Zu den Anpassungen des Herstellers gehören unter anderem Änderungen in den Sicherheitsrelevanten Softwarekernen und der Projektierung, welche auf den proprietären Softwarecodes der Firma Alstom basieren. Diese sind lizenzrechtlich geschützt, sodass Fremdunternehmen die Software nicht verändern dürfen. Neben der DZR-Software sind davon auch die Schnittstellencontroller zu den Elementen der Außenanlage betroffen. Beispielhaft sei hier die Signalansteuerung genannt. Des Weiteren ist eine produktneutrale Ausschreibung diverser Komponenten nicht möglich, da es sich nicht um einen Neubau eines eigenständigen Bereiches handelt, sondern um Anpassungen in der Bestandsanlage, sodass die Komponenten verschiedener Hersteller zu denen des Bestandes passen müssen (z.B. Steckertypen, Auswerteeinheiten etc.). Vor diesem Hintergrund wurde entschieden, die hier vorliegenden Leistungen in einem Verhandlungsverfahren ohne Teilnahmewettbewerb zu vergeben.
