Explanation:
Negocierea fără invitaţie prealabilă la o procedură concurenţială de ofertare, potrivit prevederilor art. 117 alin. (1) lit. c), alin. (2) lit. c) și alin. 4) din Legea 99/2016 privind achizițiile sectoriale, datorită următoarelor circumstanțe:Toate dezvoltările software aferente implementării noilor module implică intervenția în concepția software-ului proprietar de aplicații EMS – SCADA și pot fi implementate doar de către producătorul și dezvoltatorul acestuia, respectiv compania GE Digital Services Europe. Aceasta are drept de proprietate intelectuală asupra aplicațiilor software și deține drepturi exclusive asupra furnizării și integrării acestui produs la nivelul CNTEE Transelectrica SA, urmare a finalizării contractului C117/2016, Înlocuire componente sistem EMS – SCADA AREVA, lucrare care beneficiază în prezent de garanția oferită de către producator.Din motivele enumerate mai sus a fost aleasă procedura de Negociere fără invitație prealabilă la o procedura concurențială de ofertare, cu proprietarul software-ului platformei EMS – SCADA, respectiv compania GE Digital Services Europe.
