Der Vertrag begründet während der Laufzeit ein ausschließliches Recht im Sinne von Art. 2 lit. f) Verordnung (EG) Nr. 1370/2007 des Europäischen Parlaments und des Rates i. V. m. § 8a Abs. 8 PBefG. Das ausschließliche Recht schützt die gegenständlichen Leistungen vor Verkehren, die das Fahrgastpotential dieser Leistungen nicht nur unerheblich beeinträchtigen, soweit sie vom Auftraggeber nicht selbst veranlasst werden. Es umfasst dabei Leistungen gemäß den §§ 42 und 43 PBefG. Auf die Ausschlusswirkungen des § 160 Abs. 3 GWB wird hingewiesen.
