La durée initiale de l’accord-cadre est de douze (12) mois à compter de la date de notification de l'accord-cadre. L’accord-cadre est reconductible tacitement trois (3) fois, à la date anniversaire, par périodes de douze mois. Le marché comprend une clause de réexamen concernant l’évolution du périmètre technique ou géographique. L’acheteur se réserve la possibilité de conclure des marchés de prestations similaires sans publicité ni mise en concurrence dans les conditions prévues à l’article R.2122-7 du code de la commande publique. Les opérateurs économiques peuvent se présenter sous forme d’entreprise individuelle ou de groupement conjoint ou solidaire. En application de l’article R.2142-22 du Code de la commande publique, l’acheteur impose que le mandataire du groupement conjoint soit solidaire, pour l’exécution du présent marché, de chacun des membres du groupement pour ses obligations contractuelles. L’opérateur économique et en cas de groupement chaque cotraitant doit demander son l’habilitation préalable en application des articles R. 2311-1 et suivants du Code de la défense (CPR personne morale). Le retour du service enquêteur a l’issue du contrôle réalisé sur la personne morale (CPR) doit obligatoirement être favorable. La visite du site sera obligatoire sous peine de rejet de l’offre.
