Explanation:
Pentru atribuirea prezentului contract, s-au avut in vedere următoarele aspecte: acest produs este un produs de serie şi va face obiectul activități de realizare a Grupurilor de Propulsie Navala T22-ST40M, care fac obiectul acordului-cadru A5/1122 din 18.8.2020 si care a fost omologat in faza prototip prin Actul nr. A2/1539 din 3.3.2020. Avand in vedere cele precizate anterior, cat si faptul ca, in conformitate cu prevederile art. 104 alin. (1) lit. b) din Legea achizitiilor publice nr. 98/2016, care precizeaza ca „Autoritatea contractanta are dreptul de a aplica procedura de negociere fara publicare prealabila a unui anunt de participare pentru atribuirea contractelor de achizitii publice de produse intr-unul din urmatoarele cazuri:
[...]
„(b) daca lucrarile, produsele sau serviciile pot fi furnizate numai de catre un anumit operator economic pentru unul dintre motivele prevazute la alin. (2)”;
Respectiv:
„(2) lit. c) protectia unor drepturi exclusive, inclusiv drepturi de proprietate intelectuala”.
Consideram ca, in situatia prezentata, sunt îndeplinite conditiile mentionate in prevederea legala invocata pentru alegerea procedurii „Negociere fara publicare prealabila” pentru achizitia a 4 (patru) motoare ST40M Pratt & Whitney Canada, in conformitate cu prevederile art. 104 alin. (1) lit. b) din Legea nr. 98/2016.
