Hankija kohaldab RHS § 95 lg 4 p 12 ettenähtud kõrvaldamise alust selle ettevõtja suhtes, kes ei ole hankijale taotluses allkirjastatult esitanud hankes nõutud konfidentsiaalsusdeklaratsiooni konfidentsiaalsuslepingu tingimustega nõustumuse kohta. Hankija kohaldab sätet kohustusliku kõrvaldamise alusena (kohtupraktika järgi, Euroopa Kohus kohtuasjas nr C 171/15 p-d 34-44).
