Justification for the accelerated procedure: Przyjazny Szpital w Połczynie Zdroju Sp. z o.o. zamierza wszcząć postępowanie o udzielenie zamówienia publicznego, którego przedmiotem jest „Dostawa leków”. Postępowanie jest prowadzone w trybie przetargu nieograniczonego, a więc w trybie najbardziej konkurencyjnym spośród przewidzianych w ustawie. Zgodnie z art.138 ust.1 ustawy Pzp, termin składania ofert nie może być krótszy niż 35 dni od dnia przekazania ogłoszenia o zamówieniu Urzędowi Publikacji UE, tym nie mniej, zgodnie z art.138 ust.2 pkt2) ustawy Pzp, Zamawiający może wyznaczyć termin składania ofert krótszy niż termin określony w ust. 1, nie krótszy jednak niż 15 dni od dnia przekazania ogłoszenia o zamówieniu Urzędowi Publikacji UE, jeżeli zachodzi pilna potrzeba udzielenia zamówienia i skrócenie terminu składania ofert jest uzasadnione. Zamawiający, działając na podstawie art. 138 ust. 2 pkt 2 ustawy z dnia 11 września 2019 r. – Prawo zamówień publicznych, wyznacza skrócony termin składania ofert w postępowaniu o udzielenie zamówienia publicznego na dostawę leków do Przyjaznego Szpitala w Połczynie Zdroju Sp. z o.o. Skrócenie terminu składania ofert z ustawowego terminu 35 dni do 15 dni jest uzasadnione pilną potrzebą zapewnienia ciągłości dostaw produktów leczniczych niezbędnych do prawidłowego funkcjonowania Szpitala oraz zapewnienia możliwości nieprzerwanego udzielania świadczeń zdrowotnych pacjentom. Przedmiotem zamówienia są produkty lecznicze i leki wykorzystywane na bieżąco w procesie leczenia pacjentów hospitalizowanych, w szczególności: antybiotyki, leki anestezjologiczne, leki stosowane w oddziałach zabiegowych. Zapewnienie ich dostępności ma bezpośrednie znaczenie dla prawidłowego funkcjonowania poszczególnych oddziałów oraz zachowania ciągłości udzielania świadczeń zdrowotnych. Obecnie obowiązujące umowy na dostawę leków wygasają / ich wartości lub ilości przewidziane w umowach ulegają wyczerpaniu w terminie 22.09.2026 r. , co powoduje konieczność przeprowadzenia nowego postępowania w czasie pozwalającym na zawarcie umowy i rozpoczęcie realizacji dostaw przed wystąpieniem ryzyka braku zabezpieczenia zapotrzebowania Szpitala. Z uwagi na specyfikę działalności leczniczej Zamawiającego oraz konieczność zapewnienia ciągłości zaopatrzenia w produkty lecznicze, prowadzenie postępowania przy zachowaniu pełnego 35-dniowego terminu składania ofert mogłoby skutkować przesunięciem terminu zawarcia umowy i rozpoczęcia realizacji dostaw do okresu, w którym istnieje ryzyko wystąpienia niedoboru leków. Należy podkreślić, że potrzeba sprawnego przeprowadzenia postępowania wynika z obiektywnych okoliczności związanych z koniecznością zapewnienia ciągłości leczenia pacjentów oraz prawidłowego funkcjonowania Szpitala. Skrócenie terminu nie jest zatem podyktowane zamiarem ograniczenia konkurencji pomiędzy wykonawcami, lecz koniecznością odpowiednio szybkiego udzielenia zamówienia. Jednocześnie Zamawiający ustalił termin składania ofert na poziomie umożliwiającym potencjalnym wykonawcom przygotowanie i złożenie ofert, z uwzględnieniem charakteru i zakresu przedmiotu zamówienia. Skrócony termin pozostaje zatem proporcjonalny do występującej pilnej potrzeby udzielenia zamówienia. Mając powyższe na uwadze, Zamawiający uznaje, że w przedmiotowym postępowaniu zachodzi pilna potrzeba udzielenia zamówienia, a skrócenie terminu składania ofert jest obiektywnie uzasadnione. W związku z powyższym zastosowanie art. 138 ust. 2 pkt 2 ustawy Prawo zamówień publicznych i wyznaczenie terminu składania ofert krótszego niż 35 dni, nie krótszego jednak niż 15 dni od dnia przekazania ogłoszenia o zamówieniu Urzędowi Publikacji Unii Europejskiej, jest zasadne.
