Justification for the duration of the framework agreement: Dit langdurige partnerschap bevordert diepgaande samenwerking en kennisdeling, essentieel voor het succes van complexe projecten. Zo behalen beide partijen hun duurzaamheidsdoelen en profiteren ze van economische voordelen die moeilijk te realiseren zijn met kort lopende overeenkomsten. Met de lange looptijd borgen wij in deze tijd van groeiende schaarste op de arbeidsmarkt de continuïteit van de dienstverlening en bouwen wij structureel een prettige, moderne samenwerking die nodig is voor innovatie, opleiding en begeleiding van (nieuwe) medewerkers, klimaatadaptatie, participatie en elektrificatie (investeringen). ECLI:NL:GHARL:2025:299 bevestigt dat een langere looptijd niet disproportioneel is als de marktpraktijk dit ondersteunt en er geen grensoverschrijdend belang is, zoals in dit geval ECLI:NL:PHR:2018:81 onderstreept dat objectieve criteria (zoals gebruikt bij onderhavige aanbesteding) doorslaggevend zijn bij de beoordeling van de looptijd. Uit de marktconsultatie voorafgaand aan de aanbesteding blijkt dat een langere looptijd noodzakelijk is om voldoende marktpartijen te interesseren.
