Der Rückbau des Anschlussbereichs ist vertraglich geschuldet. Die Änderung der Bautechnologie ist auf die Bestandssituation zurückzuführen und hat daher keinen Einfluss auf den Gesamtcharakter des Auftrags. / 

863: Die Erstellung der Ausführungsplanung inkl. der erforderlichen Standsicherheitsnachweise ist durch den AN-Bau vertraglich geschuldet. Im Zuge dessen wurde erkannt, dass der Entwurf aus statisch-konstruktiven Gründen nicht umgesetzt werden kann. Dies konnte der AG im Rahmen seiner Sorgfaltspflicht nicht vorhersehen. Grundsätzlich ist ein Baugrubenverbau vertraglich geschuldet. Der Umstand, dass dieser nun abweichend hergestellt werden muss, hat keinen Einfluss auf den Gesamtcharakter des Auftrags.
