Other justification: Bei der Maßnahme handelt es sich um eine Lieferleistung. Die Finanzierung erfolgt überwiegend aus der Leistungs- und Finanzierungsvereinbarung (LuFV). Die Ausschreibung der Maßnahme erfolgt als Freihändige Vergabe ohne Wettbewerb (EU: Verhandlungsverfahren ohne ÖT) zu den Bedingungen des Modulvertrag 5. Zulässig gemäß SektVO, §13, Abs. 2, Punkt 3. (wenn der Auftrag nur von einem bestimmten Unternehmen erbracht oder bereitgestellt werden kann, wegen des Schutzes von ausschließlichen Rechten, einschließlich der Rechte des geistigen Eigentums). Bei diesem Einzelprojekt handelt es sich um die Anpassung und Änderung von bestehenden ESTW. Diese können nur durch den Ersteller der Bestandsanlage realisiert werden, u.a. wegen der Änderung und Anpassung von bestehender Hard- und Software. Des Weiteren sind EBA-Zulassungen für die Systeme erforderlich. Diese erfolgen nur für die Gesamtanlage (ESTW-UZ/-Z mit ESTW-A).
