Reason for modification: Need for modifications because of circumstances which a diligent buyer could not predict.
Description: MKA 111 Um die Umsetzung aller zur Inbetriebnahme erforderlichen Baumaßnahmen sicherzustellen sind im Verlauf der Bauausführung zustäzliche Sperrpausen und Zugpausen nötig geworden. Dieser zusätzliche Bedarf an Sperrpausen wurde durch eine Baueffizienzprüfung der Zentrale (damals I.NIG 3) ausgearbeitet. Dieser Umstand war zum Zeitpunkt der Ausschreibung nicht bekannt, sodass diese Sperrpausen kein Bestandteil der Bauphasenplanung waren. Die Bauphasenplanung aus Anlage 12 ist gemäß Anlage 1.0 Absatz 1.3 maßgeblich für die Kalkulation zu berücksichtigen. Demnacht wurden für diese zusätzlichen Sperrpausen im HV keine Eisenbahnbetrieblichen Leistungen aus Anlage 1.2 einkalkuliert. Die eisenbahnbetrieblichen Leistungen gemäß Anlage 1.2 für die in der Bauphasenplanung enthaltenen Sperrpausen sind bereits Bestandteil des Hauptvertrags.
