Les prestations sont réparties en lot séparés : - Lot n°1 : Trois véhicules « type Pick-up électrique » -- Les prestations seront rémunérées par application d'un prix global et forfaitaire ; - Lot n°2 : Trois véhicules « légers bennes bicarburation » -- Les prestations seront rémunérées par application d'un prix global et forfaitaire. Le présent marché est passé selon une procédure d’appel d’offres ouvert, en application des articles R2124-2-1°, R2161-2 à R2161-5 du Code de la commande publique. Dans le cadre de cette consultation, la Ville de Nîmes, agissant en tant que pouvoir adjudicateur, est désignée ci-après "acheteur public". Les prestations objet du contrat seront réglées par application d’un prix global et forfaitaire, selon les stipulations de l'acte d'engagement. Les différents marchés allotis ne sont pas reconductibles. Les prix sont fermes pour toute la durée du présent marché. Le paiement sera effectué en une fois après constatation du service fait, dans les conditions des articles 11.2 et 11.7 du CCAG-FCS, ou, si l’exécution est supérieure à 1 mois, sous la forme d’acomptes trimestriels correspondant aux prestations réalisées et après constatation du service fait.

Le cahier des clauses administratives générales applicable est le CCAG-FCS applicable aux marchés publics de fournitures courantes et de services, approuvé par l’arrêté du 30 mars 2021, dans sa version en vigueur au mois M_0. Chacun des lots fera l’objet d’un marché séparé. Un même candidat peut présenter une offre pour un, plusieurs ou chaque lot. Il n'y a pas de nombre de lot maximum attribuable à un même soumissionnaire. L’exécution des prestations n'est pas fractionnée en tranche. L’exécution des prestations n’est pas fractionnée en phases. La durée du marché est fixée à l’acte d’engagement. Les délais d’exécution et leurs points de départ sont détaillés précisément au CCTP sous réserve d’une amélioration du délai de livraison au sein de l’offre du candidat. Les variantes à l'initiative des candidats ne sont pas autorisées. Aucune variante à l'initiative de l'acheteur public n'est prévue dans le cadre de cette consultation.
