Additional information: 1. Zamawiający wymaga przedłożenia następujących przedmiotowych środków dowodowych (dotyczy Zadania nr 1, 2, 3, 4, 5): Wykonawca ubiegający się o udzielenie zamówienia musi wykazać, że oferowane przez niego rozwiązanie posiada badanie zgodności typu przeprowadzone przy zastosowaniu wymagań określonych w Rozporządzeniu Komisji (UE) 2023/1694 z dnia 28 września 2023 r. w sprawie technicznej specyfikacji interoperacyjności w zakresie podsystemów „Sterowanie” systemu kolei w Unii Europejskiej lub badanie równoważne. Jako przedmiotowy środek dowodowy w zakresie, o którym mowa w zdaniu pierwszym, Wykonawca wraz z ofertą zobowiązany jest złożyć Certyfikat Badania Typu WE Składnika Interoperacyjności według modułu CB dla oferowanego rozwiązania lub dokument równoważny. 2. O udzielenie Zamówienia mogą ubiegać się Wykonawcy, którzy nie podlegają wykluczeniu z postępowania oraz spełniają warunki udziału w postępowaniu. 3. Wykluczeniu z postępowania podlegają Wykonawcy, wobec których zachodzą okoliczności określone: 1) w art. 108 ust. 1 ustawy Pzp, z wyłączeniem art. 108 ust. 1 pkt 1 lit. h) ustawy Pzp oraz art. 108 ust. 1 pkt 2 w związku z art. 108 ust 1 pkt 1 lit h) ustawy Pzp oraz art. 109 ust. 1 pkt 4 ustawy Pzp; 2) w art. 7 ust. 1 ustawy z dnia 13 kwietnia 2022 r. ustawy o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz służących ochronie bezpieczeństwa narodowego (Dz.U. z 2025 r. poz. 514); 3) w art. 5k rozporządzenia Rady (UE) nr 833/2014 z dnia 31 lipca 2014 r. (Dz. Urz. UE nr L 229 z 31.7.2014, str. 1). 4. Zamawiający określa następujące warunki udziału w postępowaniu: 1) Zdolności do występowania w obrocie gospodarczym: Zamawiający nie określa wymagania w tym zakresie. 2) Uprawnień do prowadzenia określonej działalności gospodarczej lub zawodowej, o ile wynika to z odrębnych przepisów: Zamawiający nie określa wymagania w tym zakresie. 3) Sytuacji ekonomicznej lub finansowej: Zamawiający nie określa wymagania w tym zakresie. 4) Zdolności technicznej lub zawodowej: Dotyczy Zadania nr 1,2,3,4,5 a) Wykonawca wykaże, że w okresie ostatnich 3 lat przed terminem składania ofert (a jeśli okres prowadzenia działalności jest krótszy to w tym okresie) wykonał zabudowę (dostawa wraz z montażem) systemu radiołączności pociągowej w zakresie pasma VHF i GSM-R do pojazdów kolejowych w co najmniej w 2 pojazdach kolejowych. b) Wykonawca wykaże, że jest wpisany na Listę Zatwierdzonych Dostawców (dalej: LZD), w rozumieniu Zasad WKZ w Grupie J-urządzenia radiołączności VHF/GSM-R i Kategorii Wyrobów lub Usług SPG-E według Załącznika nr 1 do Zasad, tj.: - znajduje się na LZD, lub - złożył wniosek o zakwalifikowanie do LZD zgodnie z Zasadami WKZ (dalej: Wniosek) - (nie później do upływu terminu składania ofert, o którym mowa w Rozdziale XIII SWZ. Za termin złożenia Wniosku uznaje się datę i godzinę jego wpływu na adres e-mail Zamawiającego wskazany w § 5 ust. 1 Zasad WKZ.) Procedura kwalifikacji Wykonawcy na LZD została określona w Zasadach WKZ. Zakończenie procedury kwalifikacji przez Zamawiającego nastąpi nie później niż przed wyborem najkorzystniejszej oferty lub unieważnieniem postępowania. 5. Ocena spełniania warunku określonego przez Zamawiającego zostanie dokonana według formuły „spełnia/nie spełnia” na podstawie dokumentów określonych w SWZ. 6. Zamawiający zastosuje procedurę odwróconą badania i oceny ofert, o której mowa w art. 139 ustawy Pzp. Termin otwarcia ofert 21 września 2026 r. godz. 12:30 Termin związania ofertą upływa w dniu 19 grudnia 2026 r.
