Der Vertrag begründet während der Laufzeit ein ausschließliches Recht im Sinne von Art. 2 lit. f) Verordnung (EG) Nr. 1370/2007 des Europäischen Parlaments und des Rates i. V. m. § 8a Abs. 8 PBefG. Das ausschließliche Recht schützt die gegenständlichen Leistungen vor Verkehren, die das Fahrgastpotential dieser Leistungen nicht nur unerheblich beeinträchtigen, soweit sie vom Auftraggeber nicht selbst veranlasst werden.
