Tenders or requests to participate may be submitted by a group of economic operators who will not be required to adopt a particular legal form prior to the award of the contract. A letter of consent between the members of the group should be included in the request to participate and all the information required under the contract notice should be provided for each member of the group. In the case of a joint tender, all members of the group assume joint and several liability to-wards the Contracting Party ([insert name]) for the performance of the contract as a whole, i.e. both financial and operational liability. The operators forming a group must designate one of them as a single point of contact (SPOC) towards the Contracting Party for the administrative, financial and operational management of the contract. Furthermore, the operators forming a group should provide information on the role of each member of the group. Criterion: Other economic or financial requirements
Description of selection criterion: The candidate must have the necessary economic and financial standing to perform the contract. Proof of the candidate's economic and financial standing may be furnished by one or more of the following references: a) the presentation of financial statements or extracts from the financial statements (last three financial years), where publication of financial statements is required under the law of the country in which the economic operator is established. b) a statement of the economic operator's overall turnover of the last three financial years available, depending on the date on which the undertaking was set up or the economic operator started trading.
Criterion: Average yearly turnover
Description of selection criterion: The candidate must have an average yearly turnover of at least EUR 8 million (average over the last 3 years). This criterion applies to the candidate as a whole, i.e. through the combined capacity of all members of the group in case of a group of economic operators.
Criterion: Financial ratio
Description of selection criterion: In reference to financial statements to be provided, the following financial ratio’s shall be met: - Average (last 3 years) of the current ratio (i.e. current assets divided by current liabilities) of the last three years must be above 1.0; - Average (last 3 years) of the solvency ratio (i.e. equity divided by total assets) of the last three years must be above 20%. This criterion applies to each member of the group in case of a group of economic operators. The candidate will provide an additional bank guarantee at first request [if ratio is insufficient (5% of the total contract amount, increased at sole discretion of contracting entity if economic situation is requesting for it)].
Criterion: Professional risk indemnity insurance
Description of selection criterion: The candidate must also provide evidence of relevant professional risk indemnity insurance. The candidate must have the necessary technical and professional ability to perform the contract. Proof of the candidate's ability must be furnished by the following means (in case of a joint tender, the combined capacity of all members is considered). The relevant professional risk indemnity insurance must have a minimum coverage of EUR 1,25 million.
Criterion: References on specified services
Description of selection criterion: The candidate must provide at least three and maximum five references for similar services performed during the past five years. Similar services means services involving pipe handling, heavy load handling, crane operations with operator, logistics yard operations, or comparable industrial handling services. References relating to services performed for Fluxys shall not be accepted. For each reference, the candidate shall provide at least the following information: client name, contract period, location, scope of services, type of equipment used, type and dimensions/weights of materials handled where available, contract value or annual volume where available, role of the candidate, and contact details of the client reference. Minimum level required: at least three references must relate to services involving crane operations with operator and/or heavy load handling in an industrial or logistics environment. At least one of these references must include pipe handling or comparable long/heavy cylindrical materials
Criterion: Measures for ensuring quality
Description of selection criterion: Quality management. The candidate must demonstrate that it operates an appropriate quality management system covering the services concerned, including operational planning, subcontractor and supplier management where applicable, quality control and inspection, maintenance of equipment, administrative follow-up, and control of non-conforming outputs. Proof must be provided by means of a valid ISO 9001 certificate, an equivalent quality management system certificate, or a description of equivalent internal quality procedures. Where a certificate is provided, the candidate shall indicate the certificate number, scope, date of issue, expiry date and issuing body. Minimum level required: the quality management system must cover, or be demonstrably applicable to, crane operations, lifting activities, logistics yard operations, equipment maintenance and/or comparable industrial handling services. In case of a group of economic operators, the quality management system must cover the member(s) actually performing the relevant services.
Criterion: Environmental management measures
Description of selection criterion: Health and safety management. The candidate must demonstrate that it has an appropriate health and safety management system for crane operations, lifting activities, pipe handling, use of vacuum lifting equipment and industrial site operations. Proof must be provided by means of a valid VCA/SCC certificate, ISO 45001 certificate or equivalent HSE management system certificate, or by a description of equivalent internal HSE procedures. Where a certificate is provided, the candidate shall indicate the certificate number, scope, date of issue, expiry date and issuing body. Minimum level required: the HSE management system must cover, or be demonstrably applicable to, operational activities on industrial sites involving lifting operations, handling of heavy loads and operation of mobile equipment.
Criterion: Environmental management measures
Description of selection criterion: Safety performance. The candidate must provide accident statistics for the past three calendar years for the entity or business unit that will perform the contract. The statistics must include, as a minimum, the number of accidents with lost time, lost time injury frequency rate, severity rate, fatalities, and the calculation method used. Minimum level required: the candidate must provide complete safety statistics for each of the past three calendar years and must explain any fatal accident or serious accident related to crane operations, lifting operations, heavy load handling or industrial site operations, including the corrective measures taken. Fluxys reserves the right to request clarifications where the information submitted is incomplete, unclear or not comparable.
Criterion: Environmental management measures
Description of selection criterion: Environmental management. The candidate must demonstrate knowledge of, and ability to comply with, the environmental requirements applicable in Belgium and in the region where the services will be performed, in particular for industrial site operations, use and maintenance of mobile equipment, fuel management, waste handling and prevention of soil or environmental contamination. Proof must be provided by means of a valid ISO 14001 certificate, an equivalent environmental management system certificate, or a description of equivalent internal environmental procedures. Where a certificate is provided, the candidate shall indicate the certificate number, scope, date of issue, expiry date and issuing body. Minimum level required: the environmental management system or internal procedures must cover, or be demonstrably applicable to, mobile equipment operations, maintenance activities, waste management and prevention of environmental incidents in an industrial or logistics environment.
Criterion: Relevant educational and professional qualifications
Description of selection criterion: Key personnel and qualifications. The candidate must provide an organizational chart and the CVs and relevant certificates of the key personnel proposed for the performance of the contract. This must include, as a minimum, the contract manager or site coordinator, the person responsible for health and safety, the person responsible for equipment maintenance, and the crane operator(s) proposed for the services. Minimum level required: a. the contract manager or site coordinator must have at least three years of relevant experience in managing crane operations, heavy load handling, logistics yard operations or comparable industrial services; b. each crane operator proposed for the services must have the training, certificates and experience required for safe operation of the proposed equipment and for pipe handling or comparable heavy load handling activities; c. the candidate must demonstrate that at least two trained and qualified crane operators are available for the performance of the contract, in order to cover shifts, absences or replacement needs; and d. the candidate must indicate which key personnel are employees of the candidate and which personnel, if any, will be made available through subcontractors or other entities. Where the candidate relies on personnel from another entity, the candidate must provide a written undertaking confirming that these resources will be available for the performance of the contract.
Criterion: Supply chain management
Description of selection criterion: Operational and administrative capability. The candidate must demonstrate that it has the operational and administrative capability to manage pipe storage yard activities, including loading and unloading of trucks, stock movements, safe handling and maintenance of stored goods, registration and communication of pipe serial numbers or other traceability data, and day-to-day coordination with Fluxys. Proof must be provided by means of a description of the candidate’s working methods, administrative tools or procedures, communication process with the client, and examples of comparable traceability or stock administration tasks performed under previous contracts. Minimum level required: the candidate must demonstrate that it has procedures or tools enabling timely registration and communication of incoming and outgoing materials, including serial numbers or equivalent traceability data, and that the personnel assigned to the contract can communicate effectively in Dutch, French or English for operational, safety and administrative purposes.
