Economic operators established in a Member State of the European Union shall be registered in one of the professional or trade registers maintained in their Member State of establishment or satisfy any other requirement set out in Annex XI of Appendix A to Law 4412/2016. In the case of economic operators established in a Member State of the European Economic Area (EEA), or in third countries that are parties to the Agreement on Government Procurement (GPA), or in third countries that do not fall under the preceding category but have concluded bilateral or multilateral agreements with the European Union concerning public procurement procedures, they shall be registered in the corresponding professional or trade registers. Economic operators established in Greece shall be registered with the Crafts, Commercial, or Industrial Chamber. Where the participating economic operator has been carrying out business activities for a period shorter than the last three (3) financial years, compliance with the above requirements under points (a) and (b) shall be assessed on the basis of the financial years during which the economic operator has been in operation. Ο Αναθέτων Φορέας αναγνωρίζει ισοδύναμα πιστοποιητικά που έχουν εκδοθεί από φορείς διαπιστευμένους από ισοδύναμους Οργανισμούς διαπίστευσης, εδρεύοντες και σε άλλα κράτη - μέλη σύμφωνα με τον Κανονισμό 765/2008. For the present contract award procedure, economic operators are required to comply with the following: A Quality Management System Certificate in accordance with ISO 9001:2015, covering activities relevant to the subject matter of the contract. An Occupational Health and Safety Management System Certificate in accordance with ISO 45001:2018. An Environmental Management System Certificate in accordance with ISO 14001:2015. The Contracting Entity recognizes equivalent certificates issued by certification bodies accredited by equivalent accreditation organizations established in other EU Member States, in accordance with Regulation (EC) No 765/2008. The Contracting Entity also accepts other appropriate evidence of equivalent quality assurance measures where the economic operator has been unable to obtain the relevant certificates within the applicable time limits for reasons beyond its control, provided that the economic operator demonstrates that the proposed quality assurance measures comply with the required quality assurance standards. Στην περίπτωση αυτή, αποδεικνύουν ότι θα έχουν στη διάθεσή τους τους αναγκαίους πόρους, με την προσκόμιση της σχετικής δέσμευσης των φορέων στην ικανότητα των οποίων στηρίζονται. Ειδικά, όσον αφορά τα κριτήρια επαγγελματικής ικανότητας που σχετίζονται με τους τίτλους σπουδών και τα επαγγελματικά προσόντα που ορίζονται στην περίπτωση στ΄ του Μέρους ΙΙ του Παραρτήματος ΧΙΙ του Προσαρτήματος Α΄ του ν. 4412/2016 ή με την σχετική επαγγελματική εμπειρία, οι οικονομικοί φορείς, μπορούν να στηρίζονται στις ικανότητες άλλων φορέων, μόνο εάν οι τελευταίοι θα εκτελέσουν τις εργασίες ή τις υπηρεσίες για τις οποίες απαιτούνται οι συγκεκριμένες ικανότητες. Τονίζεται ρητώς ότι ο συμμετέχων μπορεί προς κάλυψη της υπό γ’ απαίτησης του όρου 2.2.6, να στηρίζεται σε τρίτο οικονομικό φορέα, αρκεί ο τρίτος οικονομικός φορέας να αναλάβει τη μελέτη και κατασκευή των προσφερόμενων λεβήτων ως συνεργαζόμενος υποπρομηθευτής ή υπεργολάβος του συμμετέχοντος. Στην περίπτωση αυτή και, εφόσον ο συμμετέχων αναλάβει την εκτέλεση της σύμβασης, τυχόν αντικατάσταση του σχετικού υποπρομηθευτή ή υπεργολάβου κατά το στάδιο της υλοποίησης μπορεί να γίνει μόνον κατόπιν εγκρίσης του Αναθέτοντος Φορέα και μόνον από έτερο οικονομικό φορέα που καλύπτει την υπό γ’ απαίτηση της παραγράφου 2.2.6. Όταν οι οικονομικοί φορείς στηρίζονται στις ικανότητες άλλων φορέων όσον αφορά τα κριτήρια που σχετίζονται με την απαιτούμενη με τη διακήρυξη οικονομική και χρηματοοικονομική επάρκεια, οι εν λόγω οικονομικοί φορείς και αυτοί στους οποίους στηρίζονται είναι από κοινού υπεύθυνοι για την εκτέλεση της σύμβασης. Υπό τους ίδιους όρους οι ενώσεις οικονομικών φορέων μπορούν να στηρίζονται στις ικανότητες των συμμετεχόντων στην ένωση ή άλλων φορέων. Ο Αναθέτων Φορέας ελέγχει αν οι φoρείς, στις ικανότητες των οποίων προτίθεται να στηριχθεί ο οικονομικός φορέας, πληρούν κατά περίπτωση τα σχετικά κριτήρια επιλογής και εάν συντρέχουν λόγοι αποκλεισμού της παραγράφου 2.2.3. Ο οικονομικός φορέας υποχρεούται να αντικαταστήσει έναν φορέα στην ικανότητα του οποίου στηρίζεται, εφόσον ο τελευταίος δεν πληροί το σχετικό κριτήριο επιλογής ή για τον οποίο συντρέχουν λόγοι αποκλεισμού, εντός προθεσμίας τριάντα (30) ημερών από την σχετική πρόσκληση του αναθέτοντος φορέας, η οποία απευθύνεται στον οικονομικό φορέα μέσω της λειτουργικότητας «Επικοινωνία» του ΕΣΗΔΗΣ. Ο φορέας που αντικαθιστά φορέα του προηγούμενου εδαφίου δεν επιτρέπεται να αντικατασταθεί εκ νέου. Ο οικονομικός φορέας αναφέρει στην αίτηση συμμετοχής του το τμήμα της σύμβασης που προτίθεται να αναθέσει υπό μορφή υπεργολαβίας σε τρίτους, καθώς και τους υπεργολάβους που προτείνει. Στην περίπτωση που o συμμετέχων αναφέρει στην αίτηση συμμετοχής του ότι προτίθεται να αναθέσει τμήμα(τα) της σύμβασης υπό μορφή υπεργολαβίας σε τρίτους σε ποσοστό που υπερβαίνει το τριάντα τοις εκατό (30%) της συνολικής αξίας της σύμβασης, ο Αναθέτων Φορέας ελέγχει ότι δεν συντρέχουν οι λόγοι αποκλεισμού της παραγράφου 2.2.3 της παρούσας. Ο οικονομικός φορέας υποχρεούται να αντικαταστήσει έναν υπεργολάβο, εφόσον συντρέχουν στο πρόσωπό του λόγοι αποκλεισμού της ως άνω παραγράφου 2.2.3. Economic operators may, with regard to the criteria relating to economic and financial standing (Section 2.2.5) and the criteria relating to technical and professional ability (Section 2.2.6), rely on the capacities of other entities, regardless of the legal nature of their links with those entities. In such cases, they shall demonstrate that they will have at their disposal the resources necessary for the performance of the contract by submitting a relevant commitment from the entities on whose capacities they rely. With regard, in particular, to the criteria relating to professional ability that concern the educational and professional qualifications referred to in point (f) of Part II of Annex XII to Appendix A of Law 4412/2016, or the relevant professional experience, economic operators may rely on the capacities of other entities only where those entities will perform the works or services for which such capacities are required. It is expressly emphasized that, for the purpose of satisfying requirement (c) of Section 2.2.6, the tenderer may rely on the capacities of a third-party economic operator, provided that such third-party economic operator undertakes the design and manufacture of the offered boilers as the tenderer's cooperating sub-supplier or subcontractor. In such case, if the tenderer is awarded the contract, any replacement of the relevant sub-supplier or subcontractor during contract implementation may take place only with the prior approval of the Contracting Entity and only by another economic operator that satisfies requirement (c) of Section 2.2.6. Where economic operators rely on the capacities of other entities with regard to the criteria relating to the economic and financial standing required under the procurement documents, those economic operators and the entities on whose capacities they rely shall be jointly liable for the performance of the contract. Under the same conditions, groups of economic operators may rely on the capacities of the members of the group or of other entities. The Contracting Entity shall verify whether the entities on whose capacities the economic operator intends to rely satisfy the relevant selection criteria, as applicable, and whether any of the grounds for exclusion set out in Section 2.2.3 apply. The economic operator shall be required to replace an entity on whose capacities it relies where that entity does not satisfy the relevant selection criterion or where grounds for exclusion apply, within thirty (30) days from receipt of the relevant request issued by the Contracting Entity through the "Communication" functionality of the National Electronic Public Procurement System (ESIDIS). An entity replacing another entity pursuant to the preceding sentence may not itself be replaced. The economic operator shall indicate in its request to participate the part of the contract that it intends to subcontract to third parties, as well as the proposed subcontractors. Where the tenderer states in its request to participate that it intends to subcontract part(s) of the contract to third parties representing more than thirty per cent (30%) of the total contract value, the Contracting Entity shall verify that none of the grounds for exclusion set out in Section 2.2.3 apply to those subcontractors. (ήτοι 30.000.000,00€) και να καλύπτουν ένα ή περισσότερα από τα ακόλουθα αντικείμενα: • Προμήθεια Λεβήτων παραγωγής ατμού, θερμού ή υπέρθερμου νερού, • Προμήθεια μονάδων συμπαραγωγής θερμικής και ηλεκτρικής ενέργειας. β) Να έχουν εκτελέσει επιτυχώς κατά την διάρκεια των πέντε (5) τελευταίων ετών (δηλαδή από το έτος 2021 έως και την καταληκτική ημερομηνία υποβολής των αιτήσεων συμμετοχής), τουλάχιστον μία (1) σύμβαση με αντικείμενο τη μελέτη, προμήθεια, εγκατάσταση, δοκιμή, θέση σε λειτουργία και παράδοση με τη μέθοδο EPC / Turn-Key λεβητοστασίου παραγωγής ατμού, θερμού ή υπέρθερμου νερού, με λέβητα ή συστοιχία λεβήτων με καύσιμο Φυσικό Αέριο, συνολικής εγκατεστημένης ονομαστικής θερμικής ισχύος τουλάχιστον 50 MWth, εκ των οποίων ένας τουλάχιστον λέβητας να έχει ονομαστική θερμική ισχύ τουλάχιστον 30 MWth. Η ανωτέρω εγκατάσταση θα πρέπει να έχει υλοποιηθεί σε βιομηχανική, ενεργειακή εγκατάσταση ή εγκατάσταση Τηλεθέρμανσης και να έχει τεθεί σε κανονική λειτουργία, λειτουργώντας επιτυχώς για τουλάχιστον ένα (1) έτος. γ) Να έχουν εκτελέσει επιτυχώς τουλάχιστον μία (1) σύμβαση, η οποία να συμπεριλαμβάνει στο συμβατικό αντικείμενο τη μελέτη και κατασκευή τουλάχιστον ενός λέβητα Φυσικού Αερίου παραγωγής ατμού, θερμού ή υπέρθερμου νερού ονομαστικής θερμικής ισχύος τουλάχιστον 30 MWth, πίεσης σχεδιασμού τουλάχιστον 10 barg και ίδιας τεχνολογίας με τους προσφερόμενους (φλογοαυλωτοί ή υδραυλωτοί - water tube boilers πολλαπλών διαδρομών καυσαερίων). Ο εν λόγω λέβητας θα πρέπει να έχει τοποθετηθεί σε βιομηχανική εγκατάσταση και να λειτουργεί επιτυχώς για τουλάχιστον ένα (1) έτος. Διευκρινίζεται ότι: Οι οικονομικοί φορείς μπορούν να επικαλούνται την ίδια σύμβαση για την κάλυψη περισσότερων εκ των αναφερόμενων ανωτέρω περιπτώσεων α’, β’ και γ’, αρκεί η εν λόγω σύμβαση να καλύπτει σωρευτικά τις απαιτήσεις των σχετικών περιπτώσεων.  Σε περίπτωση ένωσης οικονομικών φορέων, οι παραπάνω απαιτήσεις μπορούν να καλύπτονται αθροιστικά από τα μέλη της ένωσης.  Εάν οι επικαλούμενες προς κάλυψη της υπό α’ απαίτησης συμβάσεις έχουν υλοποιηθεί από τον οικονομικό φορέα ως μέλος ένωσης οικονομικών φορέων, προσμετράται μόνο η συμβατική αξία που αντιστοιχεί στο ποσοστό συμμετοχής του στην εν λόγω ένωση.  Για την απόδειξη της κάλυψης των απαιτήσεων υπό β’ και γ’ οι οικονομικοί φορείς μπορούν να επικαλούνται συμβάσεις που έχουν υλοποιήσει ως μέλη ένωσης οικονομικών φορέων, αρκεί στην εν λόγω ένωση, είτε να ήταν συντονιστές/επικεφαλής (Leader), είτε να είχαν ποσοστό συμμετοχής τουλάχιστον ίσο με το τριάντα τοις εκατό (30%)». With regard to the technical and professional capacity for the present contract award procedure, economic operators are required to: a) Have successfully performed, during the last five (5) years (i.e. from 2021 up to and including the deadline for submission of applications to participate), one or more contracts with an aggregate contract value of at least one hundred percent (100%) of the estimated value of the present contract, excluding VAT (i.e. EUR 30,000,000.00), covering one or more of the following scopes: Supply of boilers for the production of steam, hot water or superheated water; Supply of combined heat and power (CHP) units. b) Have successfully performed, during the last five (5) years (i.e. from 2021 up to and including the deadline for submission of applications to participate), at least one (1) contract involving the design, supply, installation, testing, commissioning and handover on an EPC / Turn-Key basis of a boiler house for the production of steam, hot water or superheated water, equipped with a boiler or a boiler train/fleet fired by natural gas, with a total installed rated thermal capacity of at least 50 MWth, of which at least one boiler must have a rated thermal capacity of at least 30 MWth. The above installation must have been implemented at an industrial facility, energy facility or district heating facility and must have been commissioned and operated successfully under normal operating conditions for at least one (1) year. c) Have successfully performed at least one (1) contract that included, within its scope, the design and construction of at least one natural-gas-fired boiler for the production of steam, hot water or superheated water, with a rated thermal capacity of at least 30 MWth, a design pressure of at least 10 barg, and using the same technology as the boilers offered (fire-tube boilers or water-tube boilers with multiple flue-gas passes). The boiler in question must have been installed at an industrial facility and must have operated successfully for at least one (1) year. It is clarified that: Economic operators may rely on the same contract to satisfy more than one of the above requirements under points a), b) and c), provided that the contract cumulatively meets the requirements of the respective provisions. In the case of a consortium/joint venture of economic operators, the above requirements may be satisfied collectively by the members of the consortium/joint venture. Where the contracts relied upon to satisfy the requirement under a) were performed by the economic operator as a member of a consortium/joint venture of economic operators, only the contract value corresponding to its percentage of participation in that consortium/joint venture shall be taken into account.
