Description of selection criterion: Betriebshaftpflichversicherung (Mit dem Angebot; Mittels Eigenerklärung): Im Rahmen der Angebotsabgabe ist eine Eigenerklärung ausreichend, dass eine entsprechende Betriebshaftlichtversicherung vorhanden ist oder alternativ spätestens vor Leistungsaufnahme abgeschlossen wird. Der Auftragnehmer ist verpflichtet, für die Dauer des Vertrages eine Haftpflichtversicherung in einer solchen Höhe abzuschließen, die den Gegebenheiten in vollem Umfang Rechnung trägt. Die Mindestdeckungssummen betragen im Einzelnen: a) Personenschäden pro Schadensfall mind. 5,0 Millionen Euro b) Sach- und Vermögensschäden pro Schadensfall mind. 5,0 Millionen Euro (einschl. Schäden nach dem Bundesdatenschutzgesetzt) c) Verlust von Schlüsseln und Transpondern für Schließanlagen pro Schadensfall mind. 500.000 EUR d) Obhuts- und Bearbeitungsschäden pro Schadensfall mind. 200.000 EUR Der Abschluss der Versicherung ist dem AG durch Vorlage einer Bestätigung des Versicherungsunternehmens vor Ausführungsbeginn erstmalig nachzuweisen. Höhe und Art der versicherten Risiken begründen keine Haftungsbeschränkung. Bei einer Bietergemeinschaft ist die Erklärung des Versicherungsunternehmens jedes einzelnen Mitgliedes der Gemeinschaft, dass im Auftragsfall die Haftpflicht aus der Teilnahme an der ARGE mitversichert ist, abzugeben. Dies hat auch zu gelten, wenn sich der Schadensersatzanspruch gegen die ARGE selbst richtet.
