Urz. UE nr L 229 z 31.7.2014, str. 1) który dodał przepis art. 5k. W celu wstępnego potwierdzenia braku podstaw do wykluczenia i spełnienia warunków udziału w postępowaniu Wykonawca składa: Oświadczenie o braku podstaw do wykluczenia i spełnianiu warunków udziału w postępowaniu – w formie wypełnionego jednolitego dokumentu sporządzonego zgodnie ze wzorem standardowego formularza zwanego dalej "jednolitym dokumentem lub JEDZ". Wykonawca, którego oferta zostanie oceniona jako najkorzystniejsza w przedmiotowym postępowaniu, w celu potwierdzenia braku podstaw do wykluczenia, na wezwanie Zamawiającego w wyznaczonym terminie, ale nie krótszym niż 10 dni, składa następujące dokumenty: 1. Oświadczenie Wykonawcy, w zakresie art. 108 ust. 1 pkt 5 ustawy Pzp, o braku przynależności do tej samej grupy kapitałowej w rozumieniu ustawy z dnia 16 lutego 2007 r. o ochronie konkurencji i konsumentów (t. j. Dz. U. z 2024 r. poz. 1616) z innym Wykonawcą, który złożył odrębną ofertę, ofertę częściową albo oświadczenia o przynależności do tej samej grupy kapitałowej wraz z dokumentami lub informacjami potwierdzającymi przygotowanie oferty, oferty częściowej niezależnie od innego Wykonawcy należącego do tej samej grupy kapitałowej Wykonawca może złożyć ww. oświadczenie na wzorze stanowiącym załącznik nr 4 do SWZ. 2.
