Interacțiunea cu ofertanții, respectiv procesul de eval a ofert se va desf după următ reguli:Pt vizual doc de atrib încarcate în SEAP, op ec trb sa aibă un program necesar vizualizarii fișierelor semnate electronic.Reguli de comunic și transm a datelor: sol de clarif ref la prez doc de atrib se vor adresa în mod exclusiv în SEAP, iar rasp la acestea vor fi publicate în SEAP. Pentru transm sol de clarif privind doc de atrib, op ec se vor înregistra în SEAP ca op ec conf prev art.5 alin.(1) din H.G. nr.395/2016 și vor transmite sol avand în vedere termenele de răspuns ale aut ctr prev la art.160-161 din Lg nr.98/2016 precum și cele de la art. 103 (2) din HG 395/2016. Pt comunic ulterioare dep ofert: comisia de eval va transm sol de clarif în legatura cu oferta prin utiliz facilităților teh disp în SEAP. Comisia de eval va analiza DUAE în corelație cu cerințele stabilite prin fișa de date a achiz.Comisia de eval va analiza și verifica fiecare ofertă dpdv al elem teh prop, iar ulterior dpdv al aspectelor fin pe care le implică.Op ec vor transmite răsp la clarificari și eventualele doc sol pe parcursul evaluării ofert prin intermediul SEAP, în format electronic, semnate cu semn electr, conf Lg nr. 455/2001.Op ec vor respecta modelul de acord-cadru și ctr subsecv–formulare anexate.Ofert va prez form de acord cadrul și ctr subsecv propus, semnat si stampilat de ofert, insotit de eventuale prop de modif a clauzelor ctr specifice, prop care se vor accepta numai in masura in care acestea nu vor fi, în mod evident, dezavantajoase pentru aut ctr. Aut ctr inf fiecare ofert cu priv la deciziile luate în ceea ce priv rez proc, respectiv atrib/încheierea ctr de achiz pub, inclusiv cu priv la motivele care stau la baza oricărei decizii de a nu atribui ctr, ori de a relua proc de atrib, cât mai curând posibil, dar nu mai târziu de 3 zile de la emiterea deciziilor respective.În cazul în care există mai multe oferte cu prețuri egale clasate pe primul loc se procedează astfel: departajarea se va face exclusiv în funcție de preț și nu prin cuantificarea altor elemente de natură teh sau alte avantaje care rezultă din modul de îndepl a ctr de către op ec în vederea departajării ofert, aut ctr va sol depunerea unor noi prop fin îmbunatățite iar op ec vor transm răsp lor în plic închis (până la crearea facilității teh de recriptare noi oferte prin SEAP) caz în care ctr va fi atribuit ofert care a prez prețul cel mai scăzut.Avand in vedere recom viceprim–ministrului, exprimate in adresa nr. 25074/19.02.2019, Primăria Sect 5 introduce urmat clauza suspens, cond de cauze independente de vointa sa: Proc de atrib a ctr de achiz pub este initiata sub incidenţa prez clauze suspens, in sensul ca incheierea acordului – cadru/ctr de achiz publica subsecv este cond de alocarea creditelor bug cu aceasta destinatie, semnarea acordului-cadru facandu-se cu respectarea dispoz ref la angajarea chelt din bug care intra sub incidenţa legisl privind fin pub.Aut ctr preciz ca va incheia acordul–cadru si ctr subsecv cu ofert declarat castigator numai in masura in care fond nec achiz vor fi asig prin alocarea creditelor bug cu aceasta destinatie. In cazul in care, creditele bugetare nu vor fi alocate, aut ctr, dupa primirea notif cu priv la neacordarea Finantarii (sumelor/cotelor defalcate de la bugetul de stat), isi rezerva dreptul de a anula proc de atrib, in cond in care nu exista o alta sursa de fin, in conf cu prev art. 212 al.(1) lit.c) din Lg 98/2016, fiind imposibila incheierea acordului–cadru/ctr de achiz pub subsecv.Ofert din cadrul acestei proc inteleg si sunt de acord ca aut ctr nu nu poate fi consid rasp pt vreun prejudiciu in cazul anularii proc de atrib,indiferent de natura prejudiciului si indiferent daca aut ctr a fost notif asupra existentei acestuia.Ofert din cadrul acestei proc accepta utilizarea cond speciale de mai sus/clauzei suspensive, asumandu-si intreaga raspundere in raport cu eventualele prejudicii pe care le-ar putea suferi in sit descrisa.
