Justification for the duration of the framework agreement: Die vorgesehene Laufzeit von fünf Jahren ist gemäß § 154 Abs. 4 BVergG ausnahmsweise sachlich gerechtfertigt, weil Hygienepapier von den abrufberechtigten Stellen bedarfsabhängig und zeitlich gestaffelt abgerufen wird und vorhandene Bestände aus Gründen der Wirtschaftlichkeit zunächst aufzubrauchen sind. Die längere Laufzeit ermöglicht einen geordneten, bestandsorientierten Übergang ohne vorzeitige Entwertung bereits vorhandener Vorräte und vermeidet dadurch unnötige Beschaffungs-, Austausch- und Entsorgungskosten. Die Rechtfertigung knüpft damit an den Gegenstand der Rahmenvereinbarung und an objektive Wirtschaftlichkeitsgesichtspunkte an.
